"THAT the email dated January 16, 2011 from S. Fechner, #308-201 Nursery Hill Drive, Re: Development Permit Amendment 2010/23 be received."

"THAT Development Permit 2010/23 be approved, which will amend Development Permit 07/07 as amended, as per the plans and reports attached to the report from the Senior Planner at the January 18, 2011 Council meeting. AND THAT Development Permit 2010/23 include: variance to the number of permitted small car stalls from 21 to 22; variance to size length of one small parking stall from 4.8m to 4.7m; variance to sub-zone boundary along the east property line from 4.0m to 2.1m to the building face and 0.59m to the balcony. AND FURTHER THAT Development Permit 2010/23 include the following conditions: that any trees removed by replaced at a minimum of a 3:1 ratio; that temporary construction fencing be installed within 2m of the park/private land boundary along the southerly section easterly property boundary that will be impacted by construction activities; that the fenced area be restored with the planting of appropriate native species to the satisfaction of the Town of View Royal; and that security be provided to ensure the restoration of the parkland is completed.
