"THAT Council approve Development Permit 2010/19 to permit the subdivision of 140 Hallowell Road as per the plan attached to the March 1, 2011 staff report from the Senior Planner. AND THAT the issuance of Development Permit 2010/19 be subject to: approval by the Director of Waste Management of the Ministry of Environment; painting the curbs yellow, installing no parking signs and establishing a no-parking covenant on the access road; including biological treatment of storm water before discharging into Esquimalt Harbour; and installing fencing around the remainder of the site. AND FURTHER THAT the Development Permit 2010/19 include the following: a variance to the setback from the property line from 15m to 3m for westerly lot boundaries of Strata Lot 1 through 13 which abut Lot 2; and a variance to the setback from the property line from 15m to 1.2m for all other property lines. AND FURTHER THAT the subzone C of the Comprehensive Development (Thetis Cove Waterfront) CD-8 Zone be designated Mixed Residential in the draft Official Community Plan. (C-22-11)"
