Expropriation of a Portion of 1701 Island Highway

"THAT the following resolution be adopted: WHEREAS, pursuant to the Community Charter, Council may expropriate, enter on, break up, take or enter into possession of and use any real property within the boundaries of the Town for municipal purposes; AND WHEREAS the Council of the Town of View Royal, deems it desirable to acquire the interests in the land as herein defined for the purposes of highway and utility works and related and ancillary works and appurtenances, all of which are part of a linear development; NOW THEREFORE the Council of the Town of View Royal resolves as follows: 1. Pursuant to the Community Charter and Expropriation Act, Council by itself and its authorized agents, for the purpose of acquiring lands determined to be necessary for the purpose of widening and improving the highway known as Island Highway and installation of utility works, all of which are part of a linear development, does hereby authorize the execution, delivery and filing of an Expropriation Notice and authorizes and approves the expropriation, entry on, breaking up, taking and entering into possession of and use of that portion of that parcel of land having a civic address of 1701 Island Highway, and legally described as PID: 004-609-034, Lot 1, Sections 1 and 104, Esquimalt District, Plan 43982 shown as "Dedicated as Road" outlined in bold on the plan prepared by Peter I.M. Broeren, BCLS, of Island Land Surveying Ltd. with a file date of March 8, 2011, a copy of which is attached hereto and titled "Schedule 'A'". 2. The Council is hereby authorized to pay such amounts of compensation for this expropriation as may be required by law to the persons properly entitled thereto. The Mayor and the Corporate Officer (the "Municipal Clerk") or one of them are hereby authorized to do all such things as are necessary or advisable to complete the entry upon the Lands and, wherever required for the purposes aforesaid, to execute and affix the Corporate Seal of the Town to any and all documents, forms, deeds and plans as may be necessary for the purpose of this resolution.
