"THAT Development Permit 2010/23 be approved which will amend Development Permit 07/07 as amended at the January 4, 2011 Council meeting as per the plans and reports attached to the report from the Senior Planner at the December 7, 2010 Committee of the Whole meeting and subject to noticing as per the requirements of Bylaw 730; AND THAT Development Permit 2010/23 include: Variance to the number of permitted small car stalls from 21 to 22; Variance to size length of one small parking stall from 4.8m to 4.7m; Variance to sub-zone boundary along the east property line from 4.0m to 2.1m to the building face and 0.59m to the balcony. AND FURTHER THAT Development Permit 2010/23 include the following conditions: That temporary construction fencing be installed within 2m of the park/private land boundary along the southerly section of the easterly property boundary that will be impacted by construction activities; That the fenced area be restored to its pre-existing conditions with the planting of appropriate native species to the Town's satisfaction; That any trees removed be replaced at a minimum of a 2:1 ratio; and That security be provided to ensure the restoration of the parkland is completed.
