"THAT the issuance of an amendment to Development Variance Permit No. 07/08 be authorized, subject to clarification of enforcement procedures, which would have the effect of including a relaxation of: Section 49 (2)(e) of Land Use Bylaw, 1990, No. 35, to allow for an LED Flashing Sign component within the second free standing sign structure; On the property described as Lot A, Section 98, Esquimalt District, Plan 27155 (1681 Island Highway), SUBJECT TO the applicant working with staff to ensure that appropriate display settings are achieved to the satisfaction of the Town of View Royal, as well as the applicant entering into a restrictive covenant, prior to issuance of the sign permit, that would restrict the flashing sign to having static images for a minimum of thirty (30) seconds (change interval), control display brightness of the sign, and limit the size of the LED sign to a maximum of 0.91 metres (3'-0") by 2.46 metres (8'-1"); all to the satisfaction of the Town of View Royal."
