"THAT Development Permit 2009/06 be approved with the following condition: Submittal of a lighting plan based on CPTED principles, minimizing night sky pollution and light spillage onto the adjacent residential properties to be approved by the Town of View Royal Engineering and Development Services Departments prior to the issuance of any building permits; AND FURTHER THAT Council approve Development Permit 2009/06 with the following variances to Land Use Bylaw, 1990, No. 35: Variance of the front yard setback from 7.5m to 0.3m for the front stairwell; Variance to the side yard setback (east) from 3.0m to 0.0m for the underground parking; Variance to the flanking side yard setback (west) from 6.0m to 3.0m; Variance to the requirement for 3 off-street loading spaces to 1 off-street loading space; Variance to the restriction on the number of small stall car spaces from 30% to 33.3%; and Variance to the required number of off-street parking spaces from 94 spaces to 66 spaces.
