Meeting Overview

The Town of View Royal Public Hearing, held on June 7, 2022, focused on two primary matters: a Temporary Use Permit for 2 Hospital Way to allow construction parking for a 336-unit rental project at 9 Erskine Lane, and a rezoning of the Glentana Village area to replace terminating land use contracts with a new Comprehensive Development zone. Discussion on the 2 Hospital Way permit centered on geotechnical safety, preserving CRD water main rights-of-way, and potential future pedestrian access. The Glentana Village rezoning discussion addressed resident concerns regarding the legal review of strata bylaws and the potential for increased development density.

David Screech0:00

Okay, thank you very much.

David Screech0:02

Good evening, everyone, and welcome.

David Screech0:04

I'm going to start by recognizing our friends and neighbors, the Esquimalt and Songhees Nation, and that their historic connections to these lands continue to this day.

David Screech0:14

So we have two public hearings tonight, and then we have our council meeting.

David Screech0:20

So the instruct the number and the ID for everything is the same.

David Screech0:25

So it is on your screen for those at home.

David Screech0:28

So 778-402-9227.

David Screech0:33

And then when prompted, enter conference ID 816-554-230 Pound.

David Screech0:39

And that'll get you through to the public hearing for number two Hospital Way, Glentana Village, and also for our council meeting.

David Screech0:48

And with that, I'm going to call the public hearing for the temporary use permit for 2 Hospital Way to order.

David Screech0:59

So all in favor, opposed, that's carried.

David Screech0:59

And I just need a motion to approve the agenda.

David Screech1:06

So I've got a statement, and it's it's a little bit of a combined statement rather than reading one out for each public hearing.

David Screech1:14

Um, so I'm gonna read this, but it will pertain to both of them.

David Screech1:19

So the proposed permit for number two hospital way was introduced at the committee of the whole meeting, and the proposed bylaw for the Glentana Village Land Use Contract Area has been introduced and has received second reading at council.

David Screech1:31

Before the temporary use permit can be considered by council, the local government act requires a public hearing.

David Screech1:37

Also, before a bylaw can be legally adopted by council, it must receive two more readings.

David Screech1:42

Your input via the public hearing process is most important to council in making a decision.

David Screech1:48

At these public hearings, any person who believes that their interest in property is affected by the proposed permit or bylaw shall be given the opportunity to be heard.

David Screech1:59

However, it is important that all who speak at this meeting restrict their remarks to the matters contained in the permit or bylaw, and it is my responsibility to ensure that all the remarks are so restricted.

David Screech2:10

So you'll be able to speak people in the room and people at home at an allotted time, which we will get to on the agenda.

David Screech2:19

And for those of you at home, you can see the numbers to call in, and the chat feature is also open tonight, and those that how to use that is also on your screen, so you can follow that through.

David Screech2:36

So to begin with, please indicate your name and address for the record, and you may then give us the benefit of your views.

David Screech2:43

Members of council may, if they so wish, ask questions off you.

David Screech2:47

However, the main function of council tonight is to listen to the views of the public, and it is not the function of council at this public hearing to debate the merits of the proposed bylaw or permit with individual citizens.

David Screech2:59

Like all public hearings, this meeting will be recorded to aid in accuracy of minute taking.

David Screech3:04

By participating in this webcast, you are consenting to being recorded, and the recording will be available on the town's website for future access.

David Screech3:12

After this public hearing has concluded, the council may, without further notice, give whatever effect council believes proper to the representations made at this public hearing.

David Screech3:22

Public is reminded that after the public hearing, council cannot hear any new information until the decision about the application is made.

David Screech3:32

Thank you, Steph.

Jeff Chow3:35

Thank you, Your Worship.

Jeff Chow3:36

Jeff Chow senior planner.

Jeff Chow3:38

Uh the notice that advertises public hearing was posted on the notice board at the municipal hall and on the town website on May 25, 2022.

Jeff Chow3:48

The notice was also mailed to 496 residents on the on May 24th within a 400 meter radius of the property.

Jeff Chow3:56

And was also advertised in two issues of the newspaper being the Times colonist on Wednesday, May 25 and Thursday, June 2nd.

Ron Mattson4:05

Yep, thank you.

David Screech4:08

And then we'll go right to you for the presentation.

Jeff Chow4:26

So this presentation basically presents some information relating to the temporary use permit.

Jeff Chow4:35

The purpose of the proposal is to use part of the property for uh as a construction parking lot for uh development of an adjacent site.

Jeff Chow4:50

It's an area that's already fenced and gated, and what they would do is they would deposit gravel on the site and to be used for parking.

Jeff Chow4:59

The regulatory framework temporary use permits.

Jeff Chow5:14

Neither of them permit parking as a primary use, and so a temporary use permit is required.

Jeff Chow5:20

The official community plan allows the consideration of temporary use permits on a case by case basis throughout the town.

Jeff Chow5:26

And under provincial regulations, temporary use permits are about allowing use that's not permitted by zoning bylaw, but also specifies conditions under which the temporary use may be carried on.

Jeff Chow5:42

It also allows construction of buildings and structures, but that doesn't apply in this case.

Jeff Chow5:59

So in this case, the uh the request is to permit to be uh to permit the use to be um used for three years um the this uh this site um this is a photo of the site that shows um some rock fragments on the site so um as a former quarried area um so one of the conditions would be uh geotechnical um uh study just to make sure that the the parking area is going to be a safe location uh the recommendation is to support the temporary use permit because it provides um uh construction parking and and really reduces the pressure for uh on street parking in the neighborhood which there's not much in this area uh and the conditions include uh uh report from the geotechnical engineer to make sure that the site is safe for the use intended uh that a five thousand dollar road cleaning deposit is is provided, and this is common to a lot of development sites where we we don't want debris entering the road.

Jeff Chow7:07

Conditions include that the Director of Engineering may require a paved apron if that's necessary to reduce the potential for soil to and gravel to migrate onto the road and damage the pavement.

Jeff Chow7:20

And also a wheel wash if uh dust and mud and other materials get tracked onto the road.

Jeff Chow7:27

Um this permit doesn't allow uh any parking or equipment to be placed on the statutory right-of-way on the site, which is um which is the capital regional district uh statutory right-of-way for the the two large uh water mains that service most of the core area.

Jeff Chow7:47

And this permit doesn't authorize any work within the road on hospital way, and it doesn't authorize more than 20 cubic meters of soil to be removed within a 12-month period.

Jeff Chow7:59

So if they do need to deposit or deposit more than 20 cubic meters of soil, it would have to apply for a soil permit.

Jeff Chow8:08

And that would be through uh depending on the quantity, either have to go staff can handle um a certain amount of gravel being deposited on the site.

Jeff Chow8:20

That uh that concludes the uh report.

Ron Mattson8:24

Okay, thank you.

Ron Mattson8:25

Councilor Matson, thank you.

Ron Mattson8:27

Uh thank you report.

Ron Mattson8:29

Just a quick question.

Ron Mattson8:30

How large is the entire site?

Jeff Chow8:34

Um I'm afraid I don't know off the top of my head, but it is uh it's I think it's larger than two hectares.

Ron Mattson8:46

I'm just curious as to how big it is.

Ron Mattson8:50

Any other questions for stab?

Ron Mattson8:52

No.

Jeff Chow8:53

Is the applicant in the room or uh they were talking about possibly purchasing by phone, okay, but I haven't heard back.

David Screech9:04

Is the is the applicant on the phone?

David Screech9:06

I mean, you do have an opportunity to provide comments if you are.

David Screech9:10

I'm not sure that you need to on this, but if you if you had anything you'd like to add, you certainly can.

Sarah Alexander9:16

Sure, thanks.

Sarah Alexander9:17

Hello, your worship and uh members of council.

Sarah Alexander9:20

My name is Sarah Alexander, and I'm the um Director of Engineeringing for West Urban Development.

Sarah Alexander9:24

We don't have a presentation because it's fairly simple, and Jeff did a really great job of his presentation.

Sarah Alexander9:30

Uh, we just want to let you know that we're excited to move forward with this development and we're trying to mitigate the construction traffic as much as possible, which is why we've requested this uh this um tamporary use permit on the neighboring property.

Sarah Alexander9:43

And we're we're looking forward to continuing with our construction.

Sarah Alexander9:46

Um, we're working with the engineering department on our servicing agreement and the um building department on releasing our building permits as soon as possible.

Sarah Alexander9:55

So thank you.

David Screech9:56

Okay, thank you very much.

John Rogers9:58

Um before we get to the point where we two questions of the applicant to make.

David Screech10:04

Sure, okay.

David Screech10:06

I mean, they're not really the applicant, right?

David Screech10:08

I mean, they're the end user, but they're not the applicant per se.

David Screech10:12

But yeah, go ahead.

John Rogers10:13

Yes, thank you.

John Rogers10:13

Uh yes, just a couple of questions.

John Rogers10:15

How many vehicles do you um plan to um park there on that on the side if permission is granted?

Sarah Alexander10:22

Sure.

Sarah Alexander10:22

Um, yeah, so I actually asked that question today.

Sarah Alexander10:25

Uh and we are the applicant.

Sarah Alexander10:27

We're um we're not the landowner, but we're the applicant for this temporary use permit.

Sarah Alexander10:31

Um, so we estimate there might be around 50 vehicles maximum on the property.

John Rogers10:39

Okay.

Sarah Alexander10:40

And we would have obviously control who would be coming on and off the property.

John Rogers10:44

Right.

John Rogers10:44

And I'm assuming then uh the convenience of parking there, uh they'll be able to use that uh trail on the water route.

David Screech10:52

Why don't you let me like get staff to speak to that, which I was going to?

John Rogers10:55

Oh, okay.

John Rogers10:56

Yes, yeah.

Speaker_Unknown10:57

Yeah.

John Rogers10:58

That's great.

John Rogers11:00

What point is that?

David Screech11:01

So, staff, maybe you could just give a a brief synopsis of the of what the discussion we just had.

Lindsay Chase11:08

Sure, thank you, your worships.

Lindsay Chase11:10

And Lindsay Chase, Director of Development Services.

Lindsay Chase11:13

Uh, we have been working with the property owners of two hospital way to secure um agreement in principle uh for pedestrian access across the the statutory right-of-way.

Lindsay Chase11:26

Uh obviously that uh depends on that there are a number of things that still need to happen for that to be occurring, uh but we are moving in the direction that council has asked us to, which is to try and try and uh facilitate uh better pedestrian connections within the town.

David Screech11:44

I think most importantly, the owners of the property have signaled an intent to enter into an agreement with the process.

Lindsay Chase11:49

Approval in principle, yes.

John Rogers11:52

So if and obviously not only the uh the residents, but um, which is vitally important, but obviously um a great convenience to those that might be or would be parking if um they're in on the number two hospital way if this uh is approved, then they won't have to go the long way around, so they there would be uh benefits as well.

Lindsay Chase12:12

I'm sure they'll still be managing to get their 10,000 steps in a day.

Lindsay Chase12:14

Okay.

John Rogers12:17

Or less.

John Rogers12:19

Thank you.

David Screech12:21

So next we go to comments from the public.

David Screech12:24

So is there anyone in the room that wanted to speak to this?

David Screech12:27

The temporary use permit on number two hospital way.

David Screech12:31

No?

Ron Mattson12:32

Okay.

David Screech12:32

Are there any callers on the line staff that we know of that for this one?

Elena Bolster12:38

Your worship, we have one public caller, last four digits seven four three zero.

David Screech12:44

Okay, thank you.

David Screech12:46

So caller with the last digits of seven four three zero.

David Screech12:50

This is your opportunity to speak if you were looking to speak on this issue.

David Screech12:56

You just need to press star six.

Speaker_0012:58

Not attempting to speak, just had audio issues with the live cast.

David Screech12:59

Go ahead.

Speaker_0013:01

Okay.

Speaker_0013:05

Thank you.

David Screech13:07

Okay, thank you.

David Screech13:12

So there's no correspondence, so then we'll move termination.

David Screech13:18

Thank you.
