1. CALL TO ORDER

Acting Mayor Rast called the Public Hearing to order at 7:00 pm

2. APPROVAL OF AGENDA

3. PUBLIC HEARING

a) Statement of Public Hearing Procedure Acting Mayor Rast made a brief statement regarding the procedures for public hearings.

b) Statement of Publication of Public Hearing The Planner advised that the notice which advertised this Public Hearing was posted on the Notice Board at the Municipal Office on April 24, 2013. The Notice was also advertised in two consecutive issues of a newspaper being the Goldstream Gazette on Wednesday, May 1, 2013, and Friday, May 3, 2013. A total of approximately 735 notices were mailed on April 25, 2013 to owners and residents of land located within a 400 metre radius of the subject property.

5. BYLAW FOR CONSIDERATION

a) Land Use Bylaw, 1990, No. 35, Amendment Bylaw No. 860, 2013 A Bylaw to Amend the Town of View Royal Land Use Bylaw with Respect to Creating the C-9 (Brew Pub) Zone and with Respect to the Rezoning of 191 and 199 Island Highway

Comments from Municipal Staff The Planner gave a brief summary of the bylaw to Council.
Comments from Applicant G. Haymes, 18 Fenton Road, stated there is no addition of new floor area as existing space will be reused and the loading zone area enclosed.
Comments from the Public a) M. Anderson, 57 View Royal Avenue, stated his support for the application. b) S. Doyle, 171 Island Highway, wished to clarify what type of retail store would be allowed within the proposed zone and what type of odour is to be expected.
- G. Haymes, applicant, noted that odour should not be an issue.
- The Planner stated that the proposed and current zone will allow for a small scale licensed retail store. c) A. Malcolm, 5 Tovey Crescent, stated his support for the application and requested that Council support or lobby for beer, alcohol and coolers to be taxed in relation to their alcohol content. d) D. Critchley, 132 St. Giles Street, stated his support for the application. e) G. Stusek, 24 Brigadoon Place, Vice-President, Campaign for Real Ale Victoria, stated his support for the application.
