BYLAW NO. 759

A BYLAW TO AMEND THE LAND USE BYLAW WITH RESPECT TO THE AMENDMENT OF THE COMPREHENSIVE DEVELOPMENT (CASINO): CD-6 ZONE AND THE REZONING OF 1680 ISLAND HIGHWAY AND THE ADJACENT CLOSED PORTION OF WILFERT ROAD TO SUBZONE B OF THE CD-6 ZONE

The Council of the Town of View Royal, in open meeting assembled, enacts as follows:

1. This Bylaw may be cited as "Land Use Bylaw, 1990, No. 35, Amendment Bylaw No. 759, 2009".

2. The Comprehensive Development (Casino): CD-6 Zone of Section 41 of Part 6 of said Bylaw No. 35 is hereby amended by deleting subsection "Permitted Uses" and inserting the following:

   "Permitted Uses

   Subzone A:

   • Casino
   • The uses permitted in the Business Park Commercial: C-7 Zone
   • Parking Structure
   • Premises licenses under the Liquor Control and Licensing Act

   Subzone B:

   • The uses permitted in the Business Park Commercial: C-7 Zone"

3. The Schedule "1" Zoning Map referred to in Section 42 of Land Use Bylaw No. 35 is amended by changing the zoning for the property legally described as Lot A (DD ES48097), Section 104, Esquimalt District, Plan 39031

   FROM:	COMPREHENSIVE DEVELOPMENT (CASINO): CD-6 ZONE
   TO:	COMPREHENSIVE DEVELOPMENT (CASINO): CD-6 SUBZONE A

   and as shown outlined and labelled "Subzone A" on the sketch plan attached hereto and forming part of this Bylaw as Schedule '1';

4. The Schedule "1" Zoning Map referred to in Section 42 of Land Use Bylaw No. 35 is amended by changing the zoning for a portion of the lot legally described as Lot 1, Section 98, Esquimalt District, Plan 5531, Except Part in Plan 649 RW and Pt of Section 104 (Wilfert Road) closed by Town of View Royal Bylaw No. 452.

   TO:	COMPREHENSIVE DEVELOPMENT (CASINO): CD-6 SUBZONE B

   and as shown outlined and labelled "Subzone B" on the sketch plan attached hereto and forming part of this Bylaw as Schedule '1';

5. The Schedule "1" Zoning Map referred to in Section 42 of Land Use Bylaw No. 35 is amended by changing the zoning for a portion of the lot legally described as Lot 1, Section 98, Esquimalt District, Plan 5531, Except Part in Plan 649 RW.

   and as shown outlined and labelled "Park" on the sketch plan attached hereto and forming part of this Bylaw as Schedule '1';
