a) AVICC Resolution Re. Owner-Occupancy Requirement for Secondary Suite

  1. Report dated January 28, 2014 from the Director of Development Services

MOVED BY: Councillor Screech SECONDED: Councillor Mattson

C-01-14 THAT the Town of View Royal submit a resolution to the Association of Vancouver Island and Coastal Communities regarding owner-occupancy of secondary suites as follows:

"WHEREAS communities want to see well-maintained residential neighbourhoods where neighbours are mutually respectful;

AND WHEREAS there is generally a higher duty of care shown to neighbours in communities with owner-occupied properties;

AND WHEREAS there is generally a higher duty of care shown by tenants when owners are present;

THEREFORE BE IT RESOLOVED THAT the Province of British Columbia be required to amend Part 26 of the Local Government Act granting the authority to require secondary suites be permitted in owner-occupied homes only." CARRIED

Robinson, MLA, Official Opposition Critic for Local Government and Sports, and to Coralee Oakes, Minister of Community, Sport and Cultural Development, reaffirming the Town’s position that donation and expense limits are an essential part of the election reform process. a) Records Management Bylaw No. 879, 2013 A Bylaw to Establish a Records Management System

b) Land Use Bylaw, 1990, No. 35, Amendment Bylaw No. 880, 2013 A Bylaw to Amend the Town of View Royal Land Use Bylaw with Respect to Creating the CD-9CS (Lakeside Village Low Density Suite Residential) Zone and with Respect to the Rezoning of 400, 404, 405, 409, 412, 413, 416, 417, 420, 424, 425, 428, 432, 433, 436, 440 and 444 Nursery Hill Drive

THAT Land Use Bylaw, 1990, No. 35, Amendment Bylaw No. 880, 2013 be given third reading. CARRIED Councillor Mattson voted in the negative

THAT upon adoption of Land Use Bylaw, 1990, No. 35, Amendment Bylaw No. 880, 2013, the Town offer the neighbouring non-participants in the rezoning application an opportunity for a Town initiated rezoning at the Town’s expense. CARRIED

c) Draft Soil Deposit and Removal Bylaw No. 869 - Bylaw Amendment and Repeal of Third Reading

THAT third reading of Bylaw No. 869, 2013 be repealed. CARRIED

MOVED BY: Councillor Mattson SECONDED: Councillor Screech

THAT Soil Deposit and Removal Bylaw No. 869, 2013 be amended by:

  • deleting subsection 11(a):
    1. The Town Staff and Council shall not issue a permit to an applicant if the proposed removal or deposit of Soil would: (a) In the opinion of a Professional Engineer based on soil test samples provided and analysed at the expense of the applicant, be likely to foul or pollute the water quality of any watercourse;
  • adding a fee schedule (Schedule B: Fees) to the bylaw;

AND THAT staff be directed to obtain consent from the Minister of Community, Sport and Cultural Development as amended in advance of third reading. CARRIED

a) L. Pakos, 336 Glenairlie Drive, questioned Council in regard to decommissioned secondary suites and the development of secondary suites policies specific to strata titled properties.

THAT there is a need to have a meeting closed to the public and persons other than the immediate members of Council, officers and employees of the Town, and those identified under Section 91 (2) of the Community Charter shall be excluded on the basis of Section 90 (1)(g) and Section 90 (2)(b) of the Community Charter. CARRIED
