I concur with the recommendation.

PURPOSE OF REPORT:

To bring Council a draft of the Bylaw that reflects comments received on December 16, 2013.

TIME CRITICAL:

Moderate. Legal review is anticipated to take a few weeks. After legal review Council will be asked to give the bylaw readings and schedule a Public Hearing.

BACKGROUND:

The zoning bylaw review has been in process for 15 months. A number of public meetings have been held, a community survey was completed and a workshop with Council was held in December 2013. The intent of the review is to update the current land use bylaw so that it reflects the long term vision and aspirations of the Town as expressed in the Official Community Plan and to ensure that it represents current best practices in land use regulation.

PROJECT INFORMATION:

Council reviewed an earlier draft of the bylaw at a workshop on December 16, 2013. Since that time, staff has worked to incorporate the comments received and the attached draft includes the following changes:

  • The lot size to enable a secondary suite has been reduced to 600m2 and certain types of home based business are now permitted in conjunction with a suite. The Owner Occupancy Requirement has not been changed.
  • Food Carts will be permitted in the P-3 zone
  • Three different levels of home based business are identified
  • Bed and Breakfast is now included as a Home Occupation and Vacation Rentals have been prohibited throughout the Town
  • Refinements were made to the C-7 and C-7A zones including a maximum front yard setback
  • Specific zones for Campgrounds and Motels have been added
  • Language around panhandle lots is included
  • Revisions were made to the proposed density bonus provisions
  • Parking standards have been revised to reflect floor area (instead of number of seats or number of doctors etc) and only include uses that are actually permitted in the bylaw
  • Sustainability provisions have been included in the draft such as requirements for permeable paving and height regulations that support solar panels on roofs.

As previously discussed, CD Zones largely retain the same provisions with the exception of minor use changes where definitions for specific types of housing units have changed, and all of the zones have been reformatted to be consistent with the remainder of the bylaw.

At this time, there are no sites that have been identified for pre-zoning. It may be necessary to consider a text amendment to the Official Community Plan in light of this. The legal review of the zoning bylaw will provide further information about this possibility.

Council had requested information with respect to side lot line setback for single family zones. Attachment 2 highlights the zone requirements in adjacent municipalities. The rear lot line setback in the draft for single family zones has been changed back to 7.5 meters. The side and flanking side lot line setback has not been changed.

Staff anticipates that additional edits and formatting will be required as we continue to fine tune the final draft of the bylaw. Staff will advise Council of any substantive content changes at the time the bylaw is brought forward for first and second reading.

BUDGET IMPLICATIONS:

Budget remains for this project to complete the legal review and to provide notification for the public hearing.

POLICY IMPLICATIONS:

A new Zoning Bylaw is consistent with the objectives of the Official Community Plan. The new bylaw provides better consistency with the OCP.

ALTERNATIVES TO STAFF RECOMMENDATION:

If Council has concerns with the proposed bylaw, additional comments are welcomed. Further edits can be made prior to sending the bylaw for legal review, and it is anticipated that the bylaw will be in a very close to final version before legal review occurs.

RECOMMENDATION:
