1. CALL TO ORDER
Mayor Screech called the Public Hearing to order at 7:13 p.m.
The Mayor acknowledged that the meeting is being held on the traditional territory of the Songhees Nation and Esquimalt Nation.

3. PUBLIC HEARING
a) Statement of Public Hearing Procedure
Mayor Screech made a brief statement regarding the procedures for public hearings.
b) Statement of Publication of Public Hearing
The Senior Planner advised that the notice that advertised this Public Hearing was posted on the notice board at Town Hall on May 25, 2022. The notice was also advertised in two consecutive issues of a newspaper being the Times Colonist on Wednesday, May 25, 2022 and Thursday, June 2, 2022. A total of approximately 1396 notices were mailed on May 25, 2022 to owners and residents of land located within a 400 metre radius of the subject property.

4.1 STAFF REPORTS
a) Zoning Bylaw No. 900, 2014, Amendment Bylaw No. 1101, 2022 to Rezone the Glentana Village Land Use Contract Area
- Report dated June 1, 2022 from the Senior Planner
The Senior Planner gave a summary of the report, noting that the proposed bylaw is to create zoning for land within the Glentana Village Land Use Contract area as required by the Local Government Act which is terminating all land use contracts as of June 30, 2024. A comprehensive development zone with subzones (zones CD-28A – CD-28F) would replace the current land use contract to acknowledge the different types of uses that are currently on the lands and minimize the creation of lawful nonconformities. All subzones would be capped at the existing number of residential units so that rezoning will be required for any proposal to increase density. The proposed zoning is intended to maintain the neighbourhood’s unique character and would be consistent with the Official Community Plan Mixed Residential land use designation.
Council and staff discussed the notification process, public inquiries, and permitted uses.

a) A. MacKenzie, 48 Falstaff Place, stated that her strata will need to have their strata bylaws legally reviewed to see if they are in keeping with the proposed zoning. She noted this would require Town of View Royal staff support.
The Director of Development Services indicated that staff are unable to provide legal services. She stated that, in her experience, it is unusual for strata bylaws to focus on land use matters and instead, they typically focus on communal use of property and corporate operations. For matters regarding land use, the Town’s bylaws take precedence over strata bylaws.
Council and Ms. MacKenzie discussed whether a coordinated approach to obtain legal advice would be possible though it was noted that strata bylaws vary for each strata.
Residents were encouraged to contact staff if they have questions concerning the zoning provisions.
b) D. Russek, 12 Ethos Place, questioned whether the zoning would allow for developers to change the outlook of the neighbourhoods.
Council and staff discussed the following:
- with the termination of the land use contract, the Zoning Bylaw’s general regulations for subjects such as parking and fencing that apply elsewhere in the Town, would also come into effect for this area;
- rezoning proposals for higher density multifamily residential would have to include entire strata plans, not just a number of individual strata lots; and
- staff administer the land use contract with limited flexibility to consider changes. Upon termination of the land use contract, additions and alterations to multifamily uses and to condominium strata sites can be considered through a development permit application.
c) B. Moysey, 50 Demos Place, questioned whether the application of zoning would impact sewer fees, garbage collection, and hydro.
