BYLAW NO. 1103

A BYLAW TO AMEND BUILDING BYLAW NO. 786, 2010

The Council of the Town of View Royal, in open meeting assembled, enacts as follows:

  1. This Bylaw may be cited as “Town of View Royal Building Bylaw, No. 786, 2010, Amendment Bylaw No. 1103, 2022”.

  2. Town of View Royal Building Bylaw, No. 786, 2010 is hereby amended as follows:

    a.) By replacing reference to “Director of Protective Services” with “Director of Development Services”;

    b.) By inserting the following new Part 10:

    Part 10: ENERGY CONSERVATION AND GHG EMISSION REDUCTION

    10.1 For building permit applications received on and after January 1, 2023:

    (a) except as provided in subsection (b), a building regulated by Part 3 of the Building Code must be designed and constructed to meet the minimum performance requirements and objectives specified in Step 2 of the Energy Step Code;

    (b) a wood frame building consisting of six storeys or less regulated by Part 3 of the Building Code must be designed and constructed to meet the minimum performance requirements and objectives specified in Step 3 of the Energy Step Code;

    (c) a building regulated by Part 9 of the Building Code must be designed and constructed to meet the minimum performance requirements and objectives specified in Step 3 of the Energy Step Code;

    10.2 The owner of any building subject to a requirement under sections 23.1 must do the following prior to the issuance of any occupancy permit in respect of the building:

    (a) submit a BC Energy Compliance Report; and

    (b) affix one of the following home energy labels to the building in a conspicuous location, upon or in close proximity to the electrical panel:

    (i) an EnerGuide Rating System label; (ii) a Passive House Certification; (iii) a Netzero home verified by a certified Canadian energy advisor; or (iv) a comparable home energy label acceptable to the building official; and

    c.) By renumbering Parts 10 to 28 to Parts 11 to 29.
