DEVELOPMENT PERMIT WITH VARIANCES APPLICATION NO. 2025-02 3560 HIGHLAND ROAD
RECOMMENDATION:
THAT Council authorize the issuance of Development Permit with Variances Application No. 2025-02 for 3560 Highland Road, in accordance with plans submitted to the Development Services Department on January 29, 2025, subject to:
a. Proposed development meeting all the Town’s Zoning Bylaw requirements, except for the following variance: i. to permit the siting of an accessory building in the front yard.
ALTERNATIVES:
THAT Council decline Development Permit with Variance Application No. 2025-02 for 3560 Highland Road.
Should Council support this alternative option, the best practice is to provide detailed reasons why it was considered that the application does not comply with the Sensitive Terrestrial Ecosystems Development Permit Area guidelines or why a variance is not supported.
PURPOSE:
The purpose of this report is to consider a proposal to construct a carport within the Sensitive Terrestrial Ecosystems Development Permit Area and vary the Zoning Bylaw requirement to locate a proposed carport in the front yard.
BACKGROUND:
This application was introduced at the April 1, 2025, Council meeting and the staff report containing details and analysis of the proposal can be found in Attachment 1.
The proposal is to construct a carport in the front yard of a rural, irregularly shaped property that is within the Sensitive Terrestrial Ecosystems Development Permit Area, which requires a variance.
COMMENTS:
Public notices were mailed to all residents and occupiers within 100m of the subject property to inform the public of the variance request, in accordance with the Town’s Development Procedures Bylaw No. 730, 2009.
Siting the carport behind the front building line would increase environmental impacts because the dwelling is located at the rear of the lot and backs onto a lake; and therefore, it is recommended that Council approve the development permit with variance.

TIME CRITICAL:
There are no time considerations for the Town. The applicant would like to install the carport while the dwelling on site is also under construction.
