Hello Robert and Stephen,
It’s been 2 weeks since I sent the following email requesting the Town of View Royal ask for a second opinion through the EGBC for the build at 12 Vickery Road.
Has a request for a second opinion been submitted?
Also, what happens if the current engineer on record will not sign off and/or the building is not completed before the building permit expires?
John and I appreciate any assistance you can provide.

Hello Robert and Stephen,
Based on my phone conversation with Robert on Tuesday (March 28th) morning, I contacted numerous structural engineers to see if they would be willing to take over our project. I was able to get a hold of Thor Tandy from UNISOL Engineering Ltd. to consider our project as I believed that Mark had quit given his March 27th email @ 5:17 p.m.
Tho Tandy said he would be willing to consider the project and asked for the background information. Today, Thor came to the jobsite to learn about the project. We were hoping he would take it on, as we believed that Mark had quit. As noted below from Thor, after discussing the situation with Mark, Thor is suggesting we continue to work with Mark from buepoint through a mediator.

When you review Mark’s March 14, 2023 “review”, you will observe there is no mention about the bowing and cracking 6x6 posts (now fully encased in 16 gauge galvanized metal) as part of his observations or instructions list which is quite concerning to me.
We would like a second opinion as to whether the building is structurally sound; however, as you can see, we cannot even get a second engineer. My understanding is only the authority with jurisdiction (i.e. Town of View Royal) can ask for a second opinion through the EGBC.
We would really appreciate if you could ask for the second opinion as we’d rather fix the problem now versus waiting until my dream home collapses.
Also, what happens if the current engineer on record will not sign off and/or the building is not completed before the building permit expires?

Hi Anna
After you and I met today, I was further apprised of the status, and issues, of the project. I understand that, for now, the construction is on hold and that a “second” opinion on the design and construction is being sought.
Following my visit, I spoke with Mark Buesink P.Eng. PE, at Buepoint, the current Engineer of Record.
I have subsequently decided that involvement by UNISOL Engineering Ltd is not practicable.
- The current contract between yourselves and Buepoint has not been (formally) terminated. Not necessarily a major obstacle but may confuse the terms of engagement of a 3rd party.
- The issues/items of concern are being viewed from incongruent directions/viewpoints (the problem descriptions I was privy to are significantly divergent). I cannot address, nor resolve, such divergences and resulting confusion on my part.
- A design/construction review is possible, however, at this stage of construction, it will be difficult, in some instances, to confirm/assure the outcomes of such review with what has been done on site. There will, no doubt, be reliance on hearsay/anecdotes; that is not the correct way to assure design/construction.
- My visit to the site was short and not intended to be a formal review, however, there were aspects of the construction that I did not understand and that I would probably deem to be non-standard. The current professional is better situated to address and comment on those items than I. As I understand, the EoR has attempted to address all/some identified inconsistencies that were proving to be difficult to resolve.
At this time, I suggest that, despite perceived insurmountable difficulties, the project would be better served by staying with the current professional(s) and that, a mediator (versed in this type of difficulty) be brought in to bring the parties together to develop a strategy/agreement to finish the work.
