4. MAYOR’S REPORT

The Mayor thanked Councillor Rogers and staff for their work on the Earth Day activities that took place at Welland Legacy Park on April 20, 2024. He described that the need for this Special Council meeting is due to the new Provincial housing legislation and its associated timelines and deadlines. He thanked the Standing Committee on Housing Legislation for the feedback that they have provided.

8.1 STAFF REPORTS

a) Transit-Oriented Area Designation Bylaw No. 1134 – (Bill 47-2023)

  1. Report dated April 15, 2024 from the Senior Planner

The Senior Planner gave a summary of the report to Council.

Council and staff discussed allowable floor space ratios; lands designated in the transit-oriented area (TOA) designation map still being subject to zoning provisions such as lot coverage, density and setbacks; inclusion of three “orphaned” parcels into the TOA map through rezoning applications at a later date; the requirement at this time to update the Official Community Plan designation for the TOA area to be consistent with the legislation; the ability to still build a single-family home in the TOA; the ability to have mixed-uses within the TOA; and the need to amend the bylaw should the bus exchange at Hospital Way shift in the future.

THAT the necessary bylaw be prepared that would designate the Transit-Oriented Area outlined in the staff report dated April 15, 2024 from the Senior Planner titled “Transit-Oriented Area Designation Bylaw No. 1134 – (Bill 47-2023)”. CARRIED

b) Small-Scale Multi-Unit Housing (Bill 44-2023) Extensions Review and Update – Coastal Flood Risk Areas

  1. Report dated April 15, 2024 from the Senior Planner

The Senior Planner provided a review of the report to Council.

Council and staff discussed the Province’s clarification regarding extension application eligibility criteria whereby establishing new or refining existing development permit areas would likely not qualify for an extension application.

Also discussed were tools, such as requirements for studies and covenants, are currently available to mitigate risks and hazards; and the management of potential Thetis Lake dam risks.

THAT the report dated April 15, 2024 from the Senior Planner titled “Small-Scale Multi-Unit Housing (Bill 44-2023) Extensions Review and Update – Coastal Flood Risk Areas” be received for information. CARRIED

THAT the Town apply for an extension based on the Capital Regional District’s report regarding the Thetis Lake dam and its hazards not being able to be practically mitigated. FAILED FOR LACK OF A SECONDER

c) SSMUH Housing Legislation and Infrastructure

  1. Report dated April 12, 2024 from the Director of Engineering

The Director of Engineering gave a summary of the report to Council.

Council and staff discussed the point at which sidewalks become a requirement; use of development cost charges to pay for assets; advance provision of the Provincial Growing Communities Fund to build sidewalks; the level of uptake that the new legislation may or may generate; and why sidewalks may not be desired by some in the Harbour Precinct.

THAT the report dated April 12, 2024 from the Director of Engineering titled “SSMUH Housing Legislation and Infrastructure” be received for information. CARRIED

8.2 COMMITTEE REPORTS

a) Minutes of the Standing Committee on Housing Legislation dated April 19, 2024

THAT the minutes of the Standing Committee on Housing Legislation dated April 19, 2024 be received. CARRIED

MOVED BY: Councillor Mattson SECONDED: Councillor Brown

THAT an application be prepared for a four-year extension from the Small Scale Multi-Unit Housing Legislation for the lands identified on the Coastal Flood Risk Areas map until the Coastal Adaptation Plan and Official Community Plan update are completed. CARRIED Councillor MacKenzie opposed

THAT a request for a four-year extension from the Small Scale Multi-Unit Housing Legislation be considered for those areas that are underserved by sidewalks to allow for the Transportation Master Plan, Drainage Master Plan, and Development Cost Charges Bylaw updates, and amendments to be completed. CARRIED Councillors Lemon and MacKenzie opposed

It was noted that staff had already addressed the third recommendation provided by the Standing Committee on Housing Legislation (SCOHL-03-24) regarding the three “orphaned” properties by removing them from the Transit-Oriented Areas Designation Map.

THAT the recommendation from the Standing Committee on Housing Legislation (SCOHL-03-24) regarding not including any non-required properties in the Transit-Oriented Areas Designation Map be received. CARRIED
