GIBRALTAR BAY GAZEBO OPTIONS

Recommendation:

THAT Council cost share, on a 50/50 basis, up to a maximum of $5,000,

  • the Strata’s removal of the gazebo located on the Gibraltar Bay Strata’s common property,
  • their installation of additional railings to close off the opening to the water’s edge/slope,
  • and their provision of any additional upland improvements, should funds remain, to create a lookout on the said common property,

to the satisfaction of the Town’s Director of Engineering.

Options:

Option Description
Option #1 See Recommendation on previous slide.
Option #2 THAT Council not provide any funds to the Gibraltar Bay Strata for either refurbishment or removal of gazebo.
Option #3 THAT Council either provide more or less than the $5,000 described in Option #1 to address either refurbishment or removal of the gazebo.
Option #4 THAT Statutory right-of-way ESS77726 registered over the Gibraltar Bay Strata’s common property be released, removing the public access provision.

Background:

  • February & March 2024 baluster damage even with increased security measures
  • Gazebo currently closed for safety reasons
  • April 2, Strata Chair spoke to View Royal Council re. extent of Town’s willingness to cost share in refurbishment or replacement
  • Refurbishment – replace railing & baluster system with cedar or powder coated aluminum rails, a new deck surface, miscellaneous carpentry work & repainting ($16-17k est.)
  • Replacement – removal ($2k est.) & provide a lookout with metal and concrete for increased durability (no est. provided)

“That a report be provided to Council regarding options for the Gibraltar Bay Gazebo, including potential funding sources, prior to the Gibraltar Bay Strata’s annual meeting scheduled for May 21, 2024.” (C-62-24)

Analysis:

Impact Category Notes
Community Impact: - Public currently has use the property through a SRW.
- Past improvements done on a 50/50 cost-shared basis.
Financial Implication: - If decision to fund, budget amendment required with funds from Casino revenue account.
- 9 stratas with public access SRWs, all with regular maintenance, repairs, & replacement requirements for stairs, walkways, railings, gazebos, benches, etc.

General Comments: - Land is private=TVR cannot choose the final improvements, if any.
- Town is an “occupier” & Council to decide if it wishes to provide funds.
- Refurbishment will have on-going costs due to roof replacement requirement in near future and continued use of wood materials.
- Recommended option supports materials with longevity, responsive to changing environmental conditions, & Green Shores principles – gazebo removal, new metal rails to close existing opening, & potential additional improvements further inland/upland.
- Any works should be to Town’s satisfaction to ensure safe public standard is met.
