FEES AND CHARGES AMENDMENT BYLAW
RECOMMENDATION:
THAT the report dated April 29, 2024, titled “Fees and Charges Amendment Bylaw” prepared by the Director of Development Services be received.
ALTERNATIVES:
There are no alternative options with this report.
PURPOSE:
The purpose of this report is to provide Council with an update on the proposed amendments to the Fees and Charges Bylaw No. 958, 2016 that pertain to building permit and development application fees.
TIME CRITICAL:
There is currently some confusion related to the interpretation of building permit application fees, and therefore, it is time critical to fix the wording in the Fees and Charges Bylaw No. 958, 2016.
EXECUTIVE SUMMARY:
Staff prepared the Fees and Charges Amendment Bylaw No. 1141, 2024 (attached) for first, second, and third reading. The proposed amendments include the following:
- update the wording on how to calculation building permit application fees and fix the incremental calculations;
- introduce a public notification fee for development permit with variance and development variance permit applications; and
- introduce a public notification fee for Board of Variance applications.
BACKGROUND:
At the Regular Meeting of Council on March 19, 2024, staff presented a report to Council on proposed amendments to the Fees and Charges Bylaw No. 958, 2016. Council received the report for information.
DISCUSSION:
The amendments introduced in the Fees and Charges Amendment Bylaw No. 1141, 2024, deal with some short-term inefficiencies and cost recovery. When the original report was presented to Council on March 19, 2024, it did not include a proposed public notification fee for Board of Variance applications. At the meeting, staff verbally recommended to Council that a public notification fee in the amount of $200 be applied to Board of Variance applications to recover the costs of the 100m notice mail out. As discussed at the meeting, this fee is consistent with the proposed public notification fee for development permit with variance and development variance permit applications. Accordingly, the Fees and Charges Amendment Bylaw includes this change.
SUSTAINABILITY/CLIMATE CHANGE IMPACTS:
There are no sustainability and climate change impacts associated with this report.
FINANCIAL IMPLICATIONS:
The proposed amendments in the Fees and Charges Amendment Bylaw No. 1141, 2024 will ensure that the Town is reimbursed for public notification associated with development applications. There are no other changes to application fees at this time.
CONCLUSION:
Staff prepared Fees and Charges Amendment Bylaw No. 1141, 2024, and it is on the May 7, 2024, Council Agenda for first, second, and third reading.
