    1. Report dated April 12, 2012 from the Chief Administrative Officer

    Staff Recommendation:

    THAT the Town of View Royal enter into the Municipal Police Unit Agreement between the Government of the Province of British Columbia and the Town of View Royal dated April 1, 2012 and that the Mayor and Director of Corporate Administration be authorized to sign.

    8.2 COMMITTEE REPORTS

    a) From the Special Budget Committee of the Whole meeting held March 26, 2012 and the Committee of the Whole meeting held April 10, 2012

    Recommendations:

    • Budget Issues/Questions
    1. THAT the Committee recommend to Council that Amanda Evans of the Garry Oak Ecosystems Recovery Team receive a $100.00 grant-in-aid to cover costs associated with representing the Town of View Royal at the 2012 Westshore Town Centre Earth Day event. (COW-18-12)

    2. THAT the Committee recommend to Council that there be no increase to the member staffing levels for the RCMP. (COW-19-12)

    1. THAT the Committee recommend to Council that staff write to the Province requesting special consideration to use up to $107,000 of the Town’s drainage development cost charge funds for the Kingham Place drain upgrade and the Island Highway crossing from 472 Island Highway to Price Road projects. (COW-20-12)

    2. THAT the Committee recommend to Council that the road closure and raising of title to portions of Bessborough/Tovey/Beaumont project be deferred to the 2013 budget process. (COW-21-12)

    • Greater Victoria JUNO Awards Bid
    1. THAT the Committee recommend that Council write a letter of support in principle to host the 2014 or 2015 JUNO awards. (COW-22-12)
    • Development Variance Permit – 2329 Evelyn Heights
    1. THAT the Committee recommend that Council consider approval of Development Variance Permit 2012/03 to vary the rear yard setback permitted in the R-1A: One Family Residential zone within the Land Use Bylaw, 1990, No. 35 from 7.5m to 5.25m as per the plans attached to the report from the Planning Technician at the April 10, 2012 Committee of the Whole meeting and as per the requirements of Bylaw 730. (COW-23-12)
    • Development Permit – 17 Eaton Avenue
    1. THAT the Committee recommend that Council consider approval of Development Permit 2012/02 as per the plans attached to the April 3, 2012 report from the Senior Planner. (COW-24-12)
    • Development Permit – 347 & 349 Island Highway
    1. THAT the Committee recommend that Council consider approval of Development Permit 2012/01, subject to noticing as per the requirements of Bylaw 730;

    AND THAT Development Permit 2012/01 include the following variances:

    • Variance to the setback to Island Highway for Strata Lot B from 4.5m to 1.2m;
    • Variance to the flanking side yard setback for Strata Lot E from 4.0m to 1.2m;
    • Variance to the setback of a common property access road from a side lot line from 9.0m to 1.1m;

    AND THAT Development Permit 2012/01 include the following conditions:

    • No cutting of trees on Lot 1 until a Development Permit has been issued for the construction of a home on proposed Lot 1;
    • Subdivision approval subject to the registration of a covenant prohibiting parking on the common property access road, inclusion of a no parking clause with the Strata bylaws and installation of no parking signs along the common property access road; and
    • Mitigation of construction impacts as recommended in the December 28, 2011 Osiris Wildlife Consulting report.

    AND FURTHER THAT Development Permit 2012/01 be forwarded to Council for consideration once it is clarified that applicable easements will permit the development as proposed. (COW-25-12)

    THAT there is a need to have a meeting closed to the public and persons other than the immediate members of Council, officers and employees of the Town, and those identified under Section 91 (2) of the Community Charter shall be excluded on the basis of Section 90 (1)(a) and Section 90 (2)(b) of the Community Charter.

  15. RISING REPORT

    a) Amendment to Council Resolutions C-276-04, C-398-05 and C-146-06, Re: Access Over a Portion of Town-Owned Land (Mellor Park)

    From the February 21, 2012 In-Camera Council Meeting

    MOVED BY: Councillor Mattson SECONDED: Councillor Screech

    THAT resolutions C-276-04, C-398-05 and C-142-06 be replaced with the following resolution:

    “THAT the current owners of 216 Hart Road be accommodated through a Town of View Royal letter of temporary permission granting access across a portion of Town-owned fee simple land (Mellor Park) until such time as:

    1.) There is change to the registered owners listed on title at the Land Title Office for 216 Hart Road; or 2.) 216 Hart Road is redeveloped through an approval or approvals for any a.) subdivision, b.) development permits, c.) development variance permits, d.) Board of Variance applications, or e.) building permits with a construction value in excess of $50,000; whichever occurs first.”
