Staff Recommendation: THAT Council authorize the issuance of Development Permit No. 2009/03 which will amend DP 07/08 to permit the construction of the 43 townhouses at 2319 Chilco Road, legally described as Lot 11, Section 98, Esquimalt District, Plan VIP84161, in 6 Phases as illustrated by the Landscape Phasing Plan dated June 27th, 2009 prepared by, 1st Team Consulting, and will include the following variances: • In Phase 1, variance to the side yard setback to the phasing boundary separating Block B from Block C from 7.5m to 1.5m. • In Phase 3, variance to the side yard setback to the phasing boundary separating Block G from Block H from 7.5m to 1.4m. • In Phase 4, variance to the side yard setback to the phasing boundary separating Block H from Block M from 7.5m to 6.0m. • In Phase 5, variance to the side yard setback to the phasing boundary adjacent to Block L from Block K from 7.5 to 1.5m.

b) Environmental Development Permit Application No. 2009/04 160 and 164 White Pine Road

Staff Recommendation: THAT Council authorize the issuance of Development Permit No. 2009/04 which will have the effect of regulating the development, construction activities, placement of fill and landscaping associated with the construction of new homes on the lots legally described as Strata Lots 1 & 2, Section 91, Esquimalt District, Plan VIS 6638 based on the recommendations and plans contained in: • June 26th, 2009 Environmental Report, Susan Blundell ENKON Environmental • June 29th, Planting Plan for Lots 1 & 2, Small & Rossell Architects • Soil Deposit Plans for Lot 1 & Lot 2, Java Designs • June 29th, 2009 Engineering Report, Scott Currie of C.N. Ryzuk & Associates Limited.

AND THAT Council grant relief from the covenant to permit the proposed construction activities, deposit of fill, planting of native species, and the construction of 1.2m unit paver path on Lot 1, as per the proposed Development Permit No.2009/04.

c) Development Variance Permit Application No. 2009/01 1701 Island Highway (SC27 Coffeehouse Inc. dba Serious Coffee)

Staff Recommendation: THAT Council authorize the issuance of Development Variance Permit No. 2009/01 which would have the effect of relaxing: • Section 48 (7)(a)(iii) of Land Use Bylaw, 1990, No. 35, to allow a free standing sign structure on a site where the buildings are located within 7.5 metres of the front and flanking lot lines; • Section 50 (2) of Land Use Bylaw, 1990, No. 35, to allow a second free standing sign structure; and • Section 50 (2) of Land Use Bylaw, 1990, No. 35, to allow for the proposed free standing sign structure to exceed the maximum allowable height of 6.0 metres (19.7 feet) to a maximum height of 8.0 metres (26.25 feet); on the property described as Lot 1, Section 1 & 104, Esquimalt District, Plan 43982 (1701 Island Highway).

d) Draft Annual Report for 2009
