Hi Dawn, I don’t have a lot of additional information and hope that the explanation below helps. Please let me know if you require any clarification.

BC Housing purchased two buildings, 94 Talcott Road, View Royal, purchase price was $15,410,000 and conditions were removed June 15, 2016; along with 844 Johnson Road, Victoria purchase price was $11,200,000 and conditions were removed June 22, 2016. Both buildings have been purchased as transitional housing primarily for people who were camping on the courthouse lawn in Victoria.

As far as BC Assessment is aware, the property is used for transitional housing which would fall within Property Class 1.

It has come to our attention that the Ministry of Children and Families is occupying some space and as such this area would be exempt and not Grantable.

For the 2017 Assessment Roll the classification of 94 Talcott Road was:

Category Classification Percentage
Land Business & Other Prov GILT 100%
Improvement Business & Other Prov GILT 100%

For the 2018 Assessment Roll the classification of 94 Talcott Road will be corrected as follows:

Category Classification Percentage
Land Residential Fully Taxable Property 92%
Land Residential Other Prov Non-GILT Properties 8%
Improvement Residential Fully Taxable Property 72%
Improvement Residential Other Prov Non-GILT Properties 28%

The classification and taxability have been corrected to reflect the current use of the property as a transitional housing operated by a service provider. The Property is no longer operating as a penitentiary or correctional centre, and as such does not qualify for class 6 Business and Other. The previous use as a penitentiary or correctional centre is specifically excluded from Class 1 which is why it was previously identified as Class 6.

Here are the excerpts from the Prescribed Classes of Property Regulation for determining Class 1 and Class 6:

Class 1 — residential

1 (1) Class 1 property shall include only:

(a) land or improvements, or both, used for residential purposes, including single family residences, duplexes, multi-family residences, apartments, condominiums, manufactured homes, nursing homes, rest homes, summer and seasonal dwellings, bunkhouses, cookhouses and ancillary improvements compatible with and used in conjunction with any of the above, but not including

(i) hotels or motels other than the portion of the hotel or motel building occupied by the owner or manager as his or her residence, (ii) land or improvements or both that are owned by the Crown in right of Canada or the Province, or by an agent of either, and are used for the purposes of (A) a penitentiary or correctional centre, (B) a provincial mental health facility as defined in the Mental Health Act, or (C) a hospital for the care of the mentally or physically handicapped, (iii) a strata accommodation property except, subject to subparagraph (iii.1), if (A) the owner of the strata accommodation property has the right to use the property for 7 or more days in the 12-month period ending June 30 of the year previous to the taxation year for which the assessment roll is completed, (B) either (I) the owner exercises the owner's right to use that property, or (II) in respect of more than 50% of the strata accommodation properties in the strata plan or contiguous strata plans, the owners exercise their right to use their property

Class 6 — business and other

6 Class 6 property shall include all land and improvements not included in Classes 1 to 5 and 7 to 9.

Hi Dawn,

As per our discussion, I will follow up with my appraiser to provide some additional details on the use and classification for this property which I will share with you.

Once I have this information, then there are a number of different steps or directions this could go so I believe it is important to first get the facts together to ensure that we have a common understanding of the use of the property.

If this change, to Property Class 1, is reflected through the revised Assessment Roll and the municipality disagrees with this, it can be appealed to the Property Assessment Appeal Board. The deadline to do so is April 30th and the cost is $30. I would encourage us to continue having conversation prior to this to see whether this could be resolved without resorting to the next level of appeal.

I will be in touch and hope to have some answers in the earlier part of next week.
