8. REPORTS 8.1 STAFF REPORTS a) Development Permit No. 2017/03 – 1342/1352 Trans-Canada Highway 1. Report dated January 30, 2018 from the Senior Planner The Senior Planner gave an overview of the report to Council, noting the variances requested and changes made to the application since the December 12, 2017 special Council meeting. In response to a question, it was noted that no parking variances have been requested and it would be difficult to enforce covenants regarding the use of interior space, such as a garage. 2. Comments from the Applicant E. Barker, Architect, and B. Forth, Landscape Architect, noted that since the previous meeting there have been amendments made to the form and character of the development including the addition of more natural materials, muted colours, a stone fence feature, removal of corrugated siding, and enhanced landscaping. 3. Prior to building permit issuance, a s. 219 Land Title Act covenant shall be registered to prohibit vehicle parking in the main driveway. The driveway is also to be marked and/or signed accordingly. 2. No structures (e.g. retaining walls) or trees that would restrict vehicle turning movements out of individual driveways and parking spaces be placed within 0.8m of either side of the main driveway. 3. A security deposit acceptable to the Town for on-site landscaping is to be provided prior to building permit issuance. Report dated January 29, 2018 from the Planner The Director of Development Services gave an overview of the report to Council. Council and staff discussed that future signage for the upper level businesses of the building would be addressed through a development permit application process at that time. 2. 9.2 FOR INFORMATION a) Letter dated January 26, 2018 from I. Bourhill, Director of Planning, City of Colwood, Re: Rezoning Application RZ-17-004 MOVED BY: Councillor Mattson SECONDED: Councillor Rogers C-27-18 THAT a letter of objection be sent to the City of Colwood regarding their application to rezone the land located at the corner of Ocean Boulevard and Island Highway for the following reasons: * the current use of the land as a park and ride provides a valuable facility that contributes to regional transportation solutions and resultantly makes a positive contribution to reductions in the region's greenhouse gas emissions; * the park and ride provides overflow parking for events at the neighbouring public recreation facility; and * an alternative park and ride site with the same or greater number of stalls has not been identified to replace this critical facility. AND THAT Council seek clarity from the City of Colwood as to the circumstances and/or conditions under which this land became road right of way and also how, as a result of those circumstances and/or conditions, ownership would necessarily be conferred to the City of Colwood upon creation of title.
