RECOMMENDATION:

THAT Temporary Use Permit 2018/01 - 280 Island Highway be approved with the following conditions:

A. Term

  • Expiry on July 31, 2019.

B. Conditions

  1. Portable structure specified and located as shown in Attachment 2.
  2. Open only on Saturdays and Sundays from 1:00 pm to 4:00 pm.
  3. A Permit To Encroach In Road Allowance issued by the Director of Engineering. The permit would set fees, establish performance standards, require maintenance, name the Town as additional insured, and require deposits to ensure removal, among other matters.

PURPOSE OF REPORT:

To consider issuance of a Temporary Use Permit for a sales office.

PROPOSAL:

The application is to allow office use as a temporary use, which would permit a sales office/trailer for a 37-unit apartment building currently under construction at 280 Island Highway. The proposal was introduced at the November 13, 2018 Committee of the Whole meeting.

Following that meeting, the applicant modified the request to extend the expiry of the permit from mid-May 2019 to July 31, 2019 in case there are construction delays.

The portable structure shown in Figure 1 is being used as a construction site office and the applicant proposes it for sales office use as well. The temporary use permit application has been submitted because the RM-3 Mixed Residential zone does not permit office use and the zone extends to the centerline of the road fronting the property.

DISCUSSION:

Public notification in accordance with the Local Government Act and Development Procedures Bylaw No. 730, 2009 was conducted in advance of this meeting.

The term and conditions of the temporary use permit would be considered and finalized by Council at the meeting. The proposal is as follows:
