8.1 STAFF REPORTS
a) Island Highway Upgrades – Western Border to Six Mile Road: Expropriation of a Portion of 1681 Island Highway
- Report dated April 21, 2011 from the Director of Corporate Administration
Staff Recommendation:
THAT Council adopt the following resolution:
WHEREAS, pursuant to the Community Charter, Council may expropriate, enter on, break up, take or enter into possession of and use any real property within the boundaries of the Town for municipal purposes;
AND WHEREAS the Council of the Town of View Royal, as expropriating authority under the Expropriation Act, issued an Expropriation Notice on April 21, 2011 in respect of the Lands herein defined for the purpose of acquiring lands determined to be necessary for the purposes of widening and improving the highway known as Island Highway and installation of utility works, all of which are part of a linear development;
AND WHEREAS the Council of the Town of View Royal, as approving authority under the Expropriation Act, deems it desirable to acquire the interests in the Lands as herein defined for the purposes of widening and improving the highway known as Island Highway and installation of utility works, all of which are part of a linear development, pursuant to the Town’s purposes;
NOW THEREFORE the Council of the Town of View Royal resolves as follows:
Pursuant to the Community Charter and the Expropriation Act, Council by itself and its authorized agents, for the purpose of acquiring lands determined to be necessary for the purposes of widening and improving the highway known as Island Highway and installation of utility works, all of which are part of a linear development, does hereby authorize and grant approval to the Town of View Royal to expropriate, enter on, break up, take and enter into possession of and use that portion of that parcel of land having a civic address of 1681 Island Highway and legally described as PID:002-564-769, Lot A, Section 98, Esquimalt District, Plan 27155 (the “Lands”).
The Mayor and the Corporate Officer (the “Municipal Clerk”) or one of them are hereby authorized to do all such things as are necessary or advisable to complete the approval requirements and, wherever required for the purposes aforesaid, to execute and affix the Corporate Seal of the Town to any and all documents, forms, deeds and plans as may be necessary for the purpose of this resolution.

The Mayor and the Corporate Officer (the “Municipal Clerk”) or one of them are hereby authorized to do all such things as are necessary or advisable to complete the approval requirements and, wherever required for the purposes aforesaid, to execute and affix the Corporate Seal of the Town to any and all documents, forms, deeds and plans as may be necessary for the purpose of this resolution.
