8.1 STAFF REPORTS
a) Island Highway Lighting Complaint
- Report dated March 4, 2016 from the Director of Protective Services
The Director of Protective Services gave an overview of the report to Council, noting that the Town does not have a mechanism to control light coming from a property. The Director of Development Services indicated that municipalities are challenged in this area as legislation does not grant the authority to regulate light. Instead, municipalities attempt to regulate lighting through form and character development permit guidelines established in the Official Community Plan Bylaw which require lighting plans for new commercial developments and through the sign bylaw provisions.
J. Penner, 409-290 Wilfert Road, stated that lighting coming into her unit is excessive especially in her bedroom. She described that she has worked successfully with the National Car Sales/Rental business and has good rapport with Jenner Chevrolet with whom she hopes to resolve her concerns regarding one light. J. Penner noted there are two lights at the Ford dealership, that are also of concern. She expressed a willingness to provide funding to the businesses to make lighting changes and does not wish to purchase black-out window coverings for her unit.
Council and staff discussed the possibility of staff contacting businesses to encourage lighting adjustments.

AND THAT the existing appointments of Sharon Ali, Mark Brennan, Dick Faulks, Julie Higginson, James O’Grady, Dan Pauls and Sid Tobias be transferred from the existing Planning and Development and Transportation Advisory Committees to the Community Development Advisory Committee for the remainder of their terms (to February 28, 2017);
