Dear Council Members,

I thank you for the earlier response to my request of November 06, 2015 to remove two trees from my property. This letter is to appeal your decision to deny my request.

I understand and appreciate that the subject trees are designated, “protected and/or significant”. I also see that the trees have grown to such a large size that they are causing structural damage to my neighbour’s retaining wall. The integrity of the wall will only continue to be jeopardized as the trees grow. Any remedial repairs to the wall would only be temporary.

As per the enclosed arborist report of June 10, 2016 completed by Tom Talbot of Makenzie and Associates,

“The cracking and damage to this retaining wall will become more severe as the trees mature and the roots continue to increase in size and diameter.”

“Given the tree species, their location close to the houses on both properties and the anticipate loss of structural supporting roots we recommend the removal of the trees prior to this root pruning to eliminate all potential future risk that would result from this root loss.”

It is inevitable that; the impact will become more severe, the costs for repeated repairs to the wall will mount and ultimately the underlying problem (i.e. the trees) will need to be addressed.
