Schedule 'A' - Policies Proposed for Repeal
Rationales for why each specific policy is no longer required.
POLICIES PROPOSED FOR REPEAL FROM POLICY MANUAL
1. Policy No. 6400-023 Traffic Study in Conjunction with Developments
This policy was created November 16, 1993 and is now superseded by the Transportation Master Plan. In some instances, dependent on the nature of the application, a traffic study may still be required from applicants. This policy is no longer required.
2. Policy No. 6400-024 New Developments, Blending with Older Character of Town
This policy was created February 15, 1994 and is not consistent with either the Official Community Plan or current development standards. This policy is no longer required.
3. Policy No. 6400-025 Development Applications on Properties Outside Sewer Specified Area
This policy was created February 15, 1994. This policy is no longer required as there is no sewer capacity moratorium in place and the Regional Urban Containment and Servicing Policy Area (RUCSPA) now establishes where servicing, including sewer, will be provided. The Town’s servicing agreement requirements describe the more specific matters, such as connections and capacity.
4. Policy No. 6400-027 Development Permit – down-zoning of incomplete projects
This policy was created November 7, 1995. This type of action – removal of permit and down-zoning – would best be accomplished by bylaw (such as the Development Procedures Bylaw) and not by policy. Also, this policy does not reflect the current permit process which sees Development Permits actionable for two years (unless work commences on a project). Finally, developments frequently take more than three months after approval to get going and down-zoning would be considered punitive. This policy is no longer required.
5. Policy No. 6400-028 Road Allowance Widths for Strata Subdivisions

This policy was created June 20, 1995 and should be deleted as a.) road allowances in stratas within the Town vary in width – many being less than 15m ; and b.) common property rules under provincial legislation allow for 6m widths – one of the primary reasons a developer would choose to undertake a strata subdivision as opposed to fee simple.
6. Policy No. 6400-031 Development Permit – No Trespassing Signs
This policy was created April 21, 1998 and should be deleted. Trespass is a private property matter and property owners are able to decide for themselves if they wish to post "No Trespassing" signage.
7. Policy No. 6400-032 Development Permit Amendments
This policy was created November 20, 2001 and should be deleted as these provisions are already contained in legislation and case law. Any person can apply for a Development Permit or a Development Variance Permit, etc. – and amendments thereto – at any time. Council is then able to consider the information and do what they deem is appropriate at the time with the application.
