PURPOSE:

To establish a policy for Councils authorization of the issuance of Development Permits.

DEFINITIONS:

POLICY:

1.0 Where Council has authorized the issuance of a Development Permit and:

1.1 The Permittee has not substantially commenced the development of the Land in accordance with an issued permit within one year from the date of issuance thereof; or

1.2 The Permittee fails to properly sign and execute a permit within three months of having received same from the Town in an executable form; or

1.3 The Permittee fails to provide the Town with information required as condition of issuance of a permit within three months of receipt of notification of such requirements from the Town.

Council may, without further consideration, rescind the resolution authorizing issuance of the development permit and proceed to adopt a bylaw which may rezone all or part of the subject property from the zoning intended to accommodate the development contemplated in the lapsed permit to whatever zone Council deems to be appropriate.

2.0 In the event that any of the circumstances referred to in Clauses 1 (a), (b), or (c) above occur, staff shall submit a report to Council accordingly, notifying Council immediately of such occurrences.

3.0 Applicants for whom Development Permits have been authorized for issuance as of the date of approval of this Policy shall be given 12 months notice to substantially commence development in accordance with the original approval.

REFERENCE:

Land Use Bylaw, 1990, No. 35, Amendment Bylaw No. 454, 2001

POLICY:

1.0 Alterations to the plans, specifications, terms and conditions of an active Development Permit previously issued by the Town of View Royal, or authorized for issuance by Council, which are requested by the Permittee may be considered, provided that:

1.1 A formal Application for Amendment to an Approved Development Permit has been submitted to the Town in accordance with the provisions of Land Use Bylaw No. 35, as amended; and

1.2 The proposed revisions do not substantially alter the development as originally approved.

PROCEDURES:

Approval of amendments to approved Development Permits must be in the form of a Council resolution.
