1.0 DEFINITIONS

1.1 "TOWN" means the TOWN OF VIEW ROYAL. 1.2 "OWNER" means the legal owner of the subject property or their authorized agent, where authorized in writing. 1.3 "COUNCIL" means the Town of View Royal Municipal Council. 1.4 "MANAGER" refers to the Town of View Royal's Director of Engineering or his/her authorized representative. 1.5 "BYLAW" refers to the Town of View Royal's Erosion and Sediment Control Bylaw No. 882. 1.6 "PROFESSIONAL" means a Professional Engineer or Professional Geoscientist, as the case may be, registered in the Province of British Columbia. 1.7 "CIVIL ENGINEER" refers to a Professional Engineer experienced in the design and construction of civil infrastructure projects and who is a member in good standing with APEGBC. 1.8 "ENVIRONMENTAL PROFESSIONAL" means a professional with expertise in environmental and/or ecological disciplines related to the management of erosion and sediment control and who is a member in good standing with his/her respective professional organization. 1.9 "ESC" means Erosion and Sediment Control. 1.10 "ESC PLAN" means an ESC plan prepared by a Professional for an ESC permit application. 1.11 "PROJECT" means all activities including clearing, site preparation, construction of civil services and infrastructure, construction of buildings and all related works and activities. 1.12 "ESC FACILITIES" includes all measures and structures, whether temporary or permanent, used to manage sediment and/or control erosion. 1.13 "ESC PERMIT" means the ESC permit issued by the TOWN for the project. 1.14 "SITE" means the lands shown on the ESC plans and included in the ESC permit application. 1.15 "TSS" means total suspended solids in mg/L as measured by standard methods for the examination of water and wastewater. 1.16 "TURBIDITY" means nephelometric turbidity units (NTU) as measured by standard methods for the examination of water and wastewater.

2.0 GENERAL NOTES

2.1 ALL WORK SHALL BE CONDUCTED IN ACCORDANCE WITH THE ESC PLANS AND THE TOWN OF VIEW ROYAL'S ESC BYLAW NO. 882. 2.2 PRIOR TO CONSTRUCTION, THE CONTRACTOR SHALL INSTALL ALL ESC MEASURES AS SHOWN ON THE ESC PLANS. THESE MEASURES SHALL BE MAINTAINED IN GOOD WORKING ORDER THROUGHOUT THE DURATION OF THE PROJECT AND SHALL NOT BE REMOVED WITHOUT THE PRIOR APPROVAL OF THE CIVIL ENGINEER. 2.3 THE CIVIL ENGINEER SHALL PROVIDE AN INITIAL ESC INSPECTION PRIOR TO CONSTRUCTION COMMENCING AND SHALL SUBMIT AN INITIAL REPORT TO THE TOWN. 2.4 CONSTRUCTION PHASING AND WORK ACTIVITY SCHEDULES SHOULD BE DESIGNED TO LIMIT SITE DISTURBANCE AND REDUCE THE POTENTIAL FOR EROSION AND SEDIMENTATION. SITE DISTURBANCE SHALL BE MINIMIZED TO THE FULLEST EXTENT POSSIBLE. 2.5 THE CONTRACTOR SHALL CONSTRUCT ALL THE ON-SITE ESC FACILITIES AS SHOWN ON THE ESC PLANS AND AS DIRECTED BY THE CIVIL ENGINEER. THESE FACILITIES SHALL BE MAINTAINED THROUGHOUT THE DURATION OF THE PROJECT UNTIL THE COMPLETION OF THE WORKS AND SERVICES. 2.6 ESC MEASURES SHALL BE IMPLEMENTED FOR ALL SOIL STOCKPILES AS SHOWN ON THE ESC PLANS OR AS DIRECTED BY THE CIVIL ENGINEER. 2.7 PRIOR TO THE SITE PREPARATION WORK, ALL ON-SITE AND OFF-SITE INLET STRUCTURES AND WATERCOURSES DOWNGRADIENT OF THE SITE SHALL BE PROTECTED AS SHOWN ON THE ESC PLANS OR AS DIRECTED BY THE CIVIL ENGINEER. 2.8 THE CONTRACTOR SHALL ENSURE THAT NO SILT OR SEDIMENT IS DISCHARGED INTO ANY TOWN DRAINAGE SYSTEM OR WATERCOURSE. 2.9 SHOULD ANY SEDIMENT ENTER THE TOWN DRAINAGE SYSTEM OR WATERCOURSE, THE CONTRACTOR SHALL IMMEDIATELY NOTIFY THE TOWN AND THE CIVIL ENGINEER. THE CONTRACTOR SHALL ALSO COMMENCE WORK IMMEDIATELY TO REMOVE THE SEDIMENT AND REPAIR ANY DAMAGE TO THE TOWN DRAINAGE SYSTEM OR WATERCOURSE. 2.10 ALL COSTS ASSOCIATED WITH ESC SHALL BE BORNE BY THE OWNER. 2.11 THE TOWN MAY REQUIRE ADDITIONAL ESC MEASURES TO BE IMPLEMENTED SHOULD THE ESC MEASURES AS SHOWN ON THE ESC PLANS PROVE TO BE INADEQUATE. 2.12 CONSTRUCTION SITE ENTRANCE AND EXIT LOCATIONS SHALL BE CONSTRUCTED AND MAINTAINED TO MINIMIZE THE TRACKING OF SEDIMENT ONTO PUBLIC ROADS. 2.13 TRUCKS HAULING EXCAVATED MATERIAL TO AND FROM THE SITE VIA PUBLIC AND/OR PRIVATE ROADS SHALL NOT TRACK MUD OR SEDIMENT ONTO THE ROAD SURFACE. ANY SUCH TRACKING SHALL BE CLEANED IMMEDIATELY. ALL TRUCKS HAULING EXCAVATED MATERIAL SHALL HAVE THEIR LOADS COVERED PRIOR TO LEAVING THE SITE.

MAINTENANCE

2.14 ACCUMULATED SEDIMENT SHALL BE REMOVED FROM ALL ESC FACILITIES ON A REGULAR BASIS AND SHALL BE DISPOSED OF AT AN APPROVED LOCATION. 2.15 ESC FACILITIES SHALL BE INSPECTED ON A REGULAR BASIS AND AFTER EVERY RAINFALL EVENT. ANY REPAIRS OR MAINTENANCE REQUIRED SHALL BE COMPLETED IMMEDIATELY. 2.16 THE CONTRACTOR SHALL MAINTAIN A LOG OF ALL ESC INSPECTIONS AND MAINTENANCE ACTIVITIES. THE LOG SHALL BE MADE AVAILABLE TO THE TOWN UPON REQUEST. 2.17 THE CIVIL ENGINEER SHALL INSPECT THE ESC FACILITIES ON A REGULAR BASIS DURING CONSTRUCTION AND SHALL PROVIDE THE TOWN WITH REGULAR INSPECTION REPORTS AS REQUIRED. 2.18 UPON COMPLETION OF THE PROJECT, ALL TEMPORARY ESC FACILITIES SHALL BE REMOVED AND ALL DISTURBED AREAS SHALL BE REVEGETATED OR OTHERWISE PERMANENTLY STABILIZED AS SHOWN ON THE ESC PLANS OR AS DIRECTED BY THE CIVIL ENGINEER. 2.19 THE CONTRACTOR SHALL PROVIDE THE TOWN WITH A LETTER OF COMPLETION UPON COMPLETION OF THE ESC WORKS.

INSPECTION

2.20 THE ESC CONTRACTOR SHALL MONITOR THE ESC FACILITIES DURING THE CONSTRUCTION PERIOD TO ENSURE THAT THEY ARE OPERATING EFFECTIVELY AND ARE IN GOOD REPAIR. 2.21 THE ESC CONTRACTOR SHALL PERFORM DAILY INSPECTIONS OF ALL ESC FACILITIES AND RECORD THE RESULTS IN AN INSPECTION LOG. 2.22 THE ESC CONTRACTOR SHALL PROVIDE THE CIVIL ENGINEER WITH A COPY OF THE INSPECTION LOG UPON REQUEST.

PROHIBITION OF DISCHARGE

2.23 NO PERSON SHALL DISCHARGE OR CAUSE OR PERMIT THE DISCHARGE OF SEDIMENT-LADEN WATER FROM THE SITE INTO THE TOWN DRAINAGE SYSTEM OR WATERCOURSE. 2.24 THE TSS CONCENTRATION IN ANY DISCHARGE FROM THE SITE SHALL NOT EXCEED 75 MG/L OR 20% ABOVE BACKGROUND LEVELS, WHICHEVER IS GREATER. 2.25 THE TURBIDITY IN ANY DISCHARGE FROM THE SITE SHALL NOT EXCEED 25 NTU OR 20% ABOVE BACKGROUND LEVELS, WHICHEVER IS GREATER. 2.26 IN THE EVENT THAT THE TSS OR TURBIDITY LIMITS ARE EXCEEDED, THE CONTRACTOR SHALL IMMEDIATELY NOTIFY THE TOWN AND THE CIVIL ENGINEER AND SHALL CEASE ALL DISCHARGE FROM THE SITE UNTIL THE ISSUE HAS BEEN RESOLVED.

DECOMMISSIONING

2.27 THE ESC CONTRACTOR SHALL REMOVE ALL TEMPORARY ESC FACILITIES ONCE THE SITE HAS BEEN PERMANENTLY STABILIZED AND UPON APPROVAL BY THE CIVIL ENGINEER. 2.28 UPON REMOVAL OF THE TEMPORARY ESC FACILITIES, ALL DISTURBED AREAS SHALL BE REVEGETATED OR OTHERWISE PERMANENTLY STABILIZED.

DELEGATION OF RESPONSIBILITY

2.29 IT IS THE RESPONSIBILITY OF THE OWNER TO ENSURE THAT THE ESC PLAN IS IMPLEMENTED AND MAINTAINED IN ACCORDANCE WITH THE ESC PERMIT AND THE ESC BYLAW. 2.30 THE OWNER MAY DELEGATE THE RESPONSIBILITY FOR THE IMPLEMENTATION AND MAINTENANCE OF THE ESC PLAN TO THE CIVIL ENGINEER OR AN ESC CONTRACTOR, PROVIDED THAT THE DELEGATION IS MADE IN WRITING AND THE TOWN IS NOTIFIED IN WRITING.
