Purpose of Report

  • To introduce Development Variance Permit application 2024-04 to reduce the rear yard setback from 6.0 m to 3.03m to construct a deck.

Relevant History

  • September 2024: Bylaw Complaint received for an unpermitted deck being constructed at 406 Creed Rd.
  • October 2, 2024: Work Without Permit and Unsafe to Occupy notice was posted on the property; and a written notice was sent to the property owners advising them that they had 30 days to remove the unauthorized construction and bring back the property to its original condition.
  • October 31, 2024: Property owner advised the Town that they would apply for a variance.
  • December 3, 2024: Development Variance Permit application received

Recommendation

THAT the Committee recommend that Council, after giving notice, consider the following motion:

  1. That Council authorize the issuance of Development Variance Permit (DVP) No. 2024-04 for 406 Creed Road, in accordance with plans submitted to Development Services on February 4, 2025, subject to: a. Proposed development meeting all Town Zoning Bylaw requirements, except for the following variances: i. reduce the rear yard setback from 6m to 3.03m.

Next Steps

After giving notice to the public of a Council meeting to consider the application and if Council supports the approval of the variance, then the property owner will be required to submit a Building Permit application and bring the structure up to current BC Building Code.
