POLICY:

1.0 As described in Part 3, Section 3.2 “Housing – Mix of Housing” in View Royal Official Community Plan Bylaw No. 361, 1999, Amendment Bylaw No. 598, 2005, a neighbourhood has the ability to opt of out the secondary suites zoning provisions through a rezoning process. As well, either a neighbourhood or an individual property owner can opt back into the secondary suites zoning provisions through a rezoning process.

For purposes of the subject bylaw, a neighbourhood shall:

1.1 comprise two or more single-family residential dwelling units located on separate legal parcels within the same Planning Area;

1.2 not be limited in terms of the maximum number of residential units included therein;

1.3 have the boundaries thereof defined by no less than 100% of the owners of properties wishing to be included in an agreement to opt out of the ability to establish secondary suites as a permitted use under the Land Use Bylaw, and shall not be required to include every property within the general area so defined.

PROCEDURES:

1.0 To opt out of the secondary suites zoning provisions, a cost-shared rezoning process is available whereby the neighbourhood property owners would cover the full cost of advertising and notification, approximately $1,200 at this time, while the Town would cover the required staff time.

2.0 To opt back into the secondary suites zoning provisions, a neighbourhood or an individual property owner could make a rezoning application with the full cost (advertising, notification, and the application fee to cover staff time) payable by the applicant(s).
