PURPOSE:

To establish a policy to specify which development activities require a Development Permit pursuant to the Natural Watercourse and Shoreline Areas Development Permit Area included in the Official Community Plan Bylaw No. 361, 1999.

DEFINITIONS:

POLICY:

1.0 A Development Permit is required for all development activities that would alter land or vegetation on parcels abutting Craigflower Creek that are not already included within another Environmental Development Permit Area.

2.0 A Development Permit is required for all development activities that would alter land or vegetation on parcels immediately abutting or situated within 15m of the natural boundary of Portage Inlet and the Esquimalt Harbour except:

2.1 Planting, maintenance and removal of soft landscaping features (e.g. trees, shrubs, grasses) on land more than 7.5m from the natural high water mark provided no existing native vegetation is disturbed AND, where applicable, the activities are in compliance with the municipal tree protection bylaw.

2.2 Construction of a building addition, accessory building or structure, or installation of hard surfacing and retaining walls, located more than 15m from the natural high water mark AND where there is at least 2m between the proposed activities and any existing native vegetation (e.g. native trees, shrubs and understorey plants).
