PURPOSE OF REPORT:

The report introduces the application for a Development Variance Permit to permit a deck and stairs addition on the rear of the property at 2 Governor’s Point Dr.

BACKGROUND:

The property is part of a small lot bare-land strata subdivision in an R-1: Detached Residential (Large Lot) zoning. The lot size is non-conforming and only 470m2, compared to the minimum 1000m2 lot size within the R-1 zone.

PROJECT INFORMATION:

The applicant wishes to expand the footprint of their deck to a more useful dimension of approximately 17’ x 16’ (5.2m x 4.8m) from a more irregular shape. The existing deck does not have access to the yard and the applicant wishes to add stairs. The stairs account for the furthest incursion into the rear yard setback. The illustration below indicates the dashed outline of the existing deck, and the proposed deck and stairs further out.

The addition to the property is still otherwise well within the requirements of the R-1 zone. The table below details the proposal.

Requested Variances

  • Variance to the rear yard setback of the R-1: Detached Residential (Large Lot) zone within Section 8.1.4 of Zoning Bylaw No. 900, 2014 from 7.5m to 3.8m

This property backs onto a waterfront park that is inaccessible due to grade and vegetation and the proposed works will be 20m from the natural boundary and, as such, not subject to an Environmental DP requirement.

DISCUSSION:

The proposed works would add utility to the property while not appearing to unduly impact the neighbours’ use or enjoyment of their properties; the three closest property owners have written in support of the application – 317 Bessborough Close, 1 Governor’s Point and 3 Governor’s Point. The proposal does not impact trees or a previously undisturbed area; the proposed extension will be built on disturbed yard covered in lawn. The properties at 3 and 4 Governor’s Point are significantly closer to their respective rear yard setbacks and to the natural boundary. Staff believes that this is not out of character with the other properties in this location and is supportive of the application.

NEXT STEPS:

The application is expected to come forward to the regular meeting of Council on June 1st 2021 for consideration.
