PURPOSE OF REPORT:

As per the request from Chief Administrative Officer, the Bylaw Department is to address complaints regarding parking on Bessborough Avenue and provide strategies to alleviate the parking situation.

BACKGROUND:

In 2020, the Bylaw Department received five complaints regarding vehicles being parked along a section of Bessborough Avenue. All complaints originated from one resident regarding vehicles parking directly across the street from the complainant's driveway.

The complainant explained that this parking activity was making it difficult for the complainant to exit safely from his driveway.

The following are the parking complaints received 2020:

• 2020-94 - 03/11/2020 resulted in warning letter
• 2020-247 - 05/29/2020 no offense
• 2020-379 - 07/29/2020 resulted in warning letter
• 2020-419 - 08/18/2020 gone on arrival
• 2020-449 - 09/02/2020 resulted in warning letter

From the five complaints received, three warning letters were sent to the registered owners of the vehicles, one complaint revealed no offense had taken place, one complaint revealed the alleged offender had departed upon Bylaw Officer's arrival. No license plate had been obtained by the complainant therefore unable to follow-up with a warning letter to the registered owner. All alleged violators were determined to be first time offenders, none of those who received warnings have reoffended to date.

DISCUSSION:

The sections of the Streets Bylaw No. 980, 2019 being used to enforce this section of road currently are:

SECTION 8: PARKING REGULATIONS

General Prohibitions for Stopping or Parking

8.1. Except when necessary to avoid conflict with traffic or to comply with the directions of a police officer or Traffic Control Device, or when allowed by signage or Permit, a driver or Owner of a vehicle must not park a vehicle:

8.1.24. on a Street in a location or manner that causes damages to adjacent trees or tree roots.

Parallel Parking

8.3. A driver or Owner of a vehicle must not parallel park on a portion of a Street, unless the vehicle is parked:

8.3.4. where there is no Curb, so that the left-hand wheels of the vehicle are no more than thirty (30) centimetres onto the Roadway, provided that six (6) metres of Roadway remain unobstructed.

The Engineering department advises that the Roadway width is 5.8 meters. This means that cars parked along this Roadway must be completely off the Roadway. The Roadway shoulder width ranges from 2.7 to 3.8 meters.

Residential Parking Only Zones

8.6. The driver of a vehicle may Park a vehicle on the Street in a signed Residential Parking Only Zone, if, within a two hundred and fifty (250) metre radius of the parcel frontage, the driver:

8.6.1. resides there; 8.6.2. is visiting an occupant there; or 8.6.3. is transacting business, performing work, or rendering services there.

“Residential Parking Only” signs installed on Bessborough Avenue would still allow for people visiting 284 Helmcken Road to park on Bessborough Avenue based on the 250 metre radius section described in the Street Bylaw No. 980, 2019. The “Residential Parking Only” signs would deter others from parking in this location. It is understood from the complainant that some of the offenders park on Bessborough to attend business at 284 Helmcken Road.

BUDGET IMPLICATIONS:

None.

ALTERNATIVE RECOMMENDATION:

THAT “Residential Parking Only” signs be installed on Bessborough Avenue which would still allow for people visiting 284 Helmcken Road to park on Bessborough Avenue based on the 250 metre radius section as described in the Street Bylaw No. 980, 2019 but deter others from parking in this location.
