PURPOSE OF REPORT

The purpose of this report is to present a new application for an Environmental Development Permit with variances to permit the construction of stairs, landscaping, and retaining walls at 275 Kerwood St. This report follows the rejection of an earlier application for similar structures (and a boathouse) at the April 14, 2020 Council meeting.

BACKGROUND

The property is 866m² and zoned R-1: Detached Residential (Large Lot) and is adjacent to Esquimalt Harbour. There were existing lawfully non-conforming structures on the property prior to the current proposal and works in the form of a boathouse which staff believes was demolished and reconstructed. The applicant has elected to not include the boathouse in the current application with an insistence that it is lawfully non-conforming at the recommendation of their legal counsel (as stated in the applicant’s letter to Council included in the attachments).
