I concur with the recommendation.
PURPOSE OF REPORT:
The purpose of this report is to introduce a Development Permit with variances to facilitate the subdivision of a town owned parcel of land at 2379 Lund Road.
BACKGROUND:
The lands were transferred to the Town on March 9, 2018 as an amenity that was part of the rezoning application at 1927 West Park Lane. At the time, there was discussion that some or all of the lands might have value as park land. The lands were transferred to the town as a fee simple title.
The parcel is divided by the Official Community Plan into two areas—one of which is designated Rural, and a smaller triangular piece that is designated for residential use. A rezoning application on behalf of the town was concluded in 2018. Area A of the parcel is zoned P-3 which permits parks, and Area B is zoned CD-19 which permits duplexes or small scale townhouses.
PROPOSAL:
This application is being brought forward to facilitate the subdivision of the land. The parcel is within the Sensitive Terrestrial Ecosystems Development Permit Area and a DP is required to allow the subdivision. The Development Permit, if approved, will vary the servicing requirements so that water service will be supplied by the developer of the land on a future date.
ANALYSIS:
This is an unusual application in that no work will occur on the parcel in terms of site clearing or preparation at this time. A future Development Permit will address the requirements of the DP area, and will likely address form and character requirements if Townhouses are proposed. This application is solely to facilitate the creation of a parcel where future water service will be the responsibility of the eventual purchaser of the land.
The variance in question will be to vary the servicing standards to not require a water service to be provided at this time. This is a variance to section 4.1 of Bylaw 985, 2017. All other services, including road works, sanitary and storm drain connections, street lighting, sidewalks (on the other side of the street) were installed with Phases 6 and 7 of the Thetis Vale development.
A future owner will go through the Development Permit process to facilitate on-site development including any clearing and blasting works and the construction of housing.
Notice to surrounding neighbours of the variance is required and will be conducted before the application is brought forward for Council consideration.
BUDGET:
No budget implications at this time.
