RE: 117 View Royal Avenue Retaining Walls
The owners of 117 View Royal Avenue, Cheyenne Perrin & Kyle Egger, are respectfully requesting relaxations to the R-1 requirements for fence & retaining wall heights. The relaxation is to allow the placement of a fence around the Sport Court in their back yard.
This property features an existing home that was just renovated. The property slopes down from front at View Royal Avenue to the rear property line, with an overall fall of approximately 7.0m - 23'. The location of the Sport Court & proposed fence beside the house on the West Side, & extends to within +/- 8.50M - +/- 27.9' of the rear (South) property line.
The proposed fence will run around the perimeter of the existing Sport Court to provide a 3.05M - 10.00' tall surround. The fence will be placed 1.00m - 3.28' away from the West side property line. This is to allow a meter wide landscape buffer between the Sport Court & the neighbouring property line. The overall height of the combined retaining wall & fence assembly is proposed at 3.66M - 12.00' at its highest point.
This proposal puts us off-sides with requirements set forth in the Town of View Royal Zoning Bylaw - 2014 No. 900 section 4.8 regarding Fences & Retaining Walls. Specifically we are requesting variances to items 4.8.1. in regards to Fence Height, & 4.8.11. in regards to Retaining Wall Height. We are requesting approval to construct a chain link fence on the existing retaining walls to a maximum combined height of 3.66M - 12.00'. The top of the proposed fence will not exceed a height of 10.00' above the Sport Court surface. For both zoning calculations the retaining wall height & guard-rail height are combined as one assembly as set forth in zoning item 4.8.12. The calculated height of the combined assembly is at its highest on the South end of the Sport Court, where the grade drops away 2.00' - 0.80m. The North end of the Sport Court is substantially set in to the grade.
The reason we are respectfully requesting this variance is due to the geography of the property. Due to the steep slopes of the lot providing no flat, usable play area the only feasible location for the Sport Court was in it's current location for the owner's family to enjoy. The 10.00' tall proposed fence & wall assembly will help to minimize interactions with the Neighbours to the West, such as errant balls going over the Neighbour's fence.
The proposed fence & retaining wall heights are similar in height & construction to existing chain link fences & rock retaining walls that occupy the West side & West Neighbours rear property line. Considerations for the Neighbours view corridor have been made to lessen the impact by use of a similar fence to the Neighbour's existing chain link fences, which provide a less obscurity for everyone's views.
Due to these factors we are requesting variances to the following items:
- Item 4.8.1. - Vary maximum fence height from 2.00m - 6.56' to 3.66M - 12.00'.
- Item 4.8.11. - Vary maximum retaining wall height from 2.00m - 6.56' to 3.66M - 12.00'.
