Hello,
We are against the Development Variance permit request from 117 View Royal, for an over-height fence AND for over-height retaining walls to 12 feet high for those reasons:
- Ocean / mountain view and house re-sell value. This would hinder direct neighbors view and would reduce the value of their house. That's the main reason why we have bylaws with the height restriction, so something like that would never happened. Again, having sports court that close to the neighboring property backyard would affect the value of the house because it is now a lifestyle issue. The backyard is not an area of relaxation anymore.
- Noise & unpleasant to look at chain-link/cement wall structure. The noise of the ball heating the ground or wall is very loud. Sports court is an ugly tall structure that is going to be in a plain view of a direct neighbor while they are attempting to relax in their backyard or simply looking in the window from their main kitchen/living area
- Liability issue. Why there is no bylaw regarding building sport courts? Something like that should never be allowed. There must be very clear bylaw regarding building sports court that takes into account the noise and other things mentioned above. Also, town hall should be responsible with taxpayer money and this looks like a very likely possibility for direct neighbors to go to court over the noise. Town hall should prevent this from happening by introducing bylaw that would limit construction of sport courts.
