CITY OF PARKSVILLE BYLAW NO. 1503
A BYLAW TO PERMIT THE USE OF GOATS FOR VEGETATION CONTROL AND MANAGEMENT
WHEREAS the Council of the City of Parksville deems it desirable to permit and regulate the renting of goats for the purpose of vegetation control and management within the City of Parksville;
AND WHEREAS in accordance with the Community Charter Act of BC, Council may, by bylaw, regulate, prohibit and impose requirements in relation to animals;
NOW THEREFORE the Council of the City of Parksville, in open meeting assembled, enacts as follows;
1. TITLE
1.1 This Bylaw may be cited as "Goat Vegetation Management Bylaw, 2014, No. 1503".
2. INTERPRETATION
2.1 Words or phrases defined in the British Columbia Interpretation Act, the Community Charter or Local Government Act or any successor legislation, shall have the same meaning when used in this bylaw unless otherwise defined in this bylaw.
2.2 In this bylaw, unless the context otherwise requires, words in the singular include the plural and gender specific terms include both genders and corporations.
2.3 The headings contained in this bylaw are for convenience only and are not to be construed as defining, or in any way limiting, the scope or the intent of the provisions of this bylaw.
2.4 If any portion of this bylaw is, for any reason, held invalid by any court of competent jurisdiction, the invalid portion shall be severed and the severance shall not affect the validity of the remainder.
2.5 In this Bylaw:
"Bylaw Enforcement Officer" means a Peace Officer, as defined in the British Columbia Interpretation Act, and those persons designated by the City as Bylaw Compliance Officers from time to time.
"City" means the City of Parksville.
"Goat" means a domestic goat, a subspecies of goat domesticated from the wild goat of southwest Asia and Eastern Europe, a member of the family Bovidae and a subspecies of the goat-antelope subfamily Caprinae, scientifically known as Capra aegagrus hircus.
"Wrangler" means a person who transports animals to and from the work site, sets up fencing and provides 24 hour care and security for the animals.
3. REGULATION
3.1 Notwithstanding Sections 2 and 5 of the City of Parksville Animal Regulation Bylaw, 1990, No. 1009, a person may keep goats on land within the City of Parksville, on a temporary basis, as part of a vegetation management business, for no more than 30 consecutive days per work site, for the purpose of vegetation control, clearing and management.
3.2 The use of goats as a means of vegetation management is considered an accessory use as part of regular land maintenance.
3.3 Notwithstanding Section 604(b) of the City of Parksville Zoning and Development Bylaw, 1994, No. 2000, one self-contained travel trailer or recreational vehicle for providing temporary accommodation to a Wrangler, and one animal transport vehicle will be permitted on the work site during the vegetation management process, but in any case, for no more than 30 consecutive days per work site.
3.4 A maximum of 15 goats per work site is permitted.
3.5 At all times goats must be contained within a fenced area while on a work site or performing their vegetation management activities, and must be cared for in a manner consistent with the requirements of the Society for Prevention of Cruelty to Animals.
3.6 A person or company providing goat vegetation management services must obtain and maintain a valid City of Parksville Business Licence in order to provide said services.
3.7 A person or company providing goat vegetation management services must obtain and maintain third party liability insurance in the amount of $5,000,000.
3.8 A person or company providing goat vegetation management services must, at all times, adhere to all relevant WorkSafeBC regulations and requirements.
3.9 Except where expressly exempt, the provision of goat vegetation management services shall be in accordance with any relevant development area guidelines and may be subject to requirements set out in a development permit issued by the City of Parksville, as well as relevant federal and provincial environmentally sensitive area guidelines and regulations.
4. ENFORCEMENT
4.1 A Bylaw Compliance Officer for the City of Parksville may enter onto any property in accordance with the Community Charter to inspect and determine whether the provisions of this bylaw are being met.
4.2 A person must not obstruct or interfere with a Bylaw Enforcement Officer who has entered onto property pursuant to Section 5.1, or other person assisting the Officer.
5. OFFENCE AND PENALTY
5.1 Any person who contravenes or violates any provision of this bylaw, or who suffers or permits any act or thing to be done in contravention of or in violation of any provision of this bylaw, or who neglects to do or refrains from doing anything required to be done by any provision of this bylaw, commits an offence, and, where the offence is a continuing one, each day that the offence is continued shall constitute a separate offence.
5.2 Upon being convicted of an offence under this bylaw, a person shall be liable to pay a maximum fine of not more than $10,000.
5.3 In addition to any other remedies available at law, this bylaw may be enforced by means of a prosecution under the Offence Act.
