PURPOSE OF REPORT

To introduce a Development Variance Permit application for 14 Jedburgh Road to vary the requirement for road improvements on the Island Highway frontage of a proposed subdivision.

BACKGROUND

A preliminary statement of conditions has been issued for Subdivision Application 2016/03 to create a nine lot single family residential subdivision comprised of five bare land strata lots and four fee simple lots as shown in Attachment 3. Development Variance Permit 2016/07 was approved June 14, 2016 to vary the required distance of the common access roadway to the existing side lot from 9m to 0m.

Section 58 of Land Use Bylaw 1990, No. 35 requires development of a site to improve road, drainage, sewer and water services to current standards along the frontage of the development site, up to the centre line of the road right-way.

PROPOSAL

The development site has two frontages:

  • Approximately 133m on Island Highway.
  • Approximately 100m on Jedburgh Road.

The proposal is to vary the requirements of Section 58 of Land Use Bylaw 1990, No. 35 so that road upgrades along the Island Highway frontage of the site not be constructed as part of this subdivision. Along the Jedburgh Road frontage of the site, a 4m strip would be dedicated to widen the road allowance and upgraded to current standards. Jedburgh Road is the access for the site, so the improvements on that road would be more beneficial to the neighbourhood and the development.

DISCUSSION

The proposal can be supported for several reasons:

  1. The 2007 Transportation Master Plan proposes a realignment of Island Highway in the area as shown in Attachment 4, but there is no design at this time. This realignment cannot be implemented on a piece-by-piece basis because it is a major project that would involve changes to other service infrastructure such as water, hydro, drainage and sewer.
  2. It is likely that any road improvements on Island Highway in this location would require removal once the details of the road realignment are established.
  3. The existing roadway, which includes a bicycle lane, extruded curb and sidewalk is adequate for the medium term.

NEXT STEPS

Council may consider the application at an upcoming meeting following notification of residents and owners of nearby properties as required by the Local Government Act and Development Procedures Bylaw No. 730, 2009.
