BYLAW NO. 1179
A BYLAW TO AMEND THE COLLECTION AND DISPOSAL OF RESIDENTIAL GARBAGE AND HOUSEHOLD FOOD WASTE BYLAW TO ADD SECONDARY AND GARDEN SUITE SERVICE AND IMPROVE WILDLIFE ATTRACTANT MITIGATION MEASURES
The Council of the Town of View Royal, in open meeting assembled, enacts as follows:
CITATION
- This Bylaw may be cited as “Collection and Disposal of Residential Garbage and Household Food Waste Bylaw No. 745, 2009, Amendment Bylaw No. 1179, 2026”.
AMENDMENTS
Collection and Disposal of Residential Garbage and Household Food Waste Bylaw 745, 2009, is hereby amended as follows:
a. By amending Section 2 by removing the subsection numbering assigned to each definition while maintaining the definitions in alphabetical order.
b. By adding the following definition in Section 2 in alphabetical order:
“Garden Suite” means a detached, self-contained dwelling unit, attached to a foundation, that is accessory to and located on the same lot as a residential detached Dwelling Unit, and does not include a strata lot, as described in Town of View Royal Zoning Bylaw No. 900, 2014;
c. By amending the following definitions in Section 2:
“Dwelling Unit” means a single family detached dwelling unit, or each dwelling unit of a duplex, or houseplex containing no more than four self-contained dwelling units, or townhouse complex with adequate collection access, that is eligible for the Town’s garbage and household food waste collection service, but does not include a secondary suite, garden suite, townhouse complex with inadequate collection access, houseplex containing more than four self-contained dwelling units, apartment building containing more than four dwelling units, a condominium building, a hotel, motel, guest house, resort or marina, any other living units for transient occupancy, or any commercial property, seasonal campsite or any complex that has commercial garbage collection containers;
“Secondary Suite” means an accessory dwelling unit located within a residential detached building, whereby the two dwelling units (the primary residence and the secondary suite) and any common spaces make up a single real estate entity that cannot be stratified or otherwise legally separated from the other, as described in Town of View Royal Zoning Bylaw No. 900, 2014;
d. By deleting Section 3 in its entirety and replacing with the following:
3. COLLECTION SERVICE
3.1 The Town’s residential garbage and household food waste collection service is mandatory for the occupants of all eligible Dwelling Units.
3.2 The owner of a residential property with a Garden Suite or a Secondary Suite may apply to the Town to participate in the residential garbage and food waste program, and the owners and occupants shall be responsible for meeting the requirements of the collection programs including the requirement for Extra Bag Decals to be attached to all bags within the carts designated for the Garden Suite and Secondary Suite.
3.3 A townhouse complex may not be eligible to participate in the residential garbage and household food waste program if the complex’s access lane is inadequate for the collection service, resulting from the townhouse complex’s development related variances to its drive lane width and geometry.
3.4 No occupant of a Dwelling Unit or Garden Suite or Secondary Suite approved to receive collection services, as defined in this Bylaw, shall dispose of residential garbage and household food waste except in accordance with the provisions of this Bylaw.
e. By deleting Section 5 in its entirety and replacing with the following:
5. COLLECTION SCHEDULE AND TIME
The occupant shall follow the weekly collection schedule as set out by the Town.
The occupant shall place the garbage and household food waste containers for collection at the curbside: a) No earlier than 5:00 a.m. on the day of the collection; b) No later than 7:00 a.m. on the day of the collection.
All garbage and household food waste shall be collected on Statutory Holidays, except Christmas Day and New Year’s Day. In the event that a collection day falls on Christmas Day and New Year’s Day, then the collection shall take place on the following day.
