a) Development Permit Application No. 2009-01 for 1651 Island Highway

  1. Report dated February 5, 2009 from the Senior Planner

Staff Recommendation:

THAT the Committee receive this report for information;

AND THAT the Committee of the Whole recommend to Council that Development Permit 2009-01 be approved immediately following the adoption of Land Use Bylaw, 1990, No. 35, Amendment Bylaw No. 728, 2009;

AND THAT Committee of the Whole recommend to Council that Development Permit 2009-01 include the following:

  • variance to the front setback from 7.5m to 4.0m for the building face and 3.2m for the canopy;
  • variance to the south-west side setback from 4.5m to 0.5m;
  • variance to the off-street loading space requirement from 2 stalls to 1 stall;
  • that the requirement that parking not be located within yard setbacks be varied to allow parking within both the front yard and side yard;
  • that the requirement that entire front yard setback, excluding driveways, be maintained as natural or landscaped greenspace be varied to allow the siting of the principle building and parking lot within the front yard setback area;
  • that the requirement that at least ½ of the required landscaped greenspace within outdoor parking areas be located in the parking lot’s interior be varied to not require any interior landscape areas;
  • that the requirement to plant trees at a spacing of at least 8 metres within the front yard setback area be varied to require the planting of at least 3 trees;
  • that the prohibition on backlit signs be varied to allow backlit signs.

b) Rezoning Application for 6 Small-Lot Single Family Homes at 347/349 Island Highway

Staff Recommendation:

THAT the Committee receive this report for information;

AND THAT the Committee recommend to Council that Land Use Bylaw, 1990, No. 35, Amendment Bylaw No. 731, 2009 and View Royal Official Community Plan Bylaw No. 361, 1999, Amendment Bylaw No. 734, 2009 receive first and second reading and that a public hearing be scheduled for March 3, 2009;

AND THAT the Committee recommend to Council that adoption of Land Use Bylaw, 1990, No. 35, Amendment Bylaw No. 731, 2009 be subject to:

  • an undertaking to register a section 219 covenant establish a natural area covenant, including the completion of a post construction survey and installation of permanent fencing along the covenant boundary;
  • an undertaking to register a section 219 covenant restricting subdivision of the subject properties to no more than six lots and not permitting any subdivision until such time as the existing homes on the property are renovated according to an approved Development Permit.
