RECOMMENDATION:

That the report dated April 26, 2013 report from the Senior Planner titled “Official Community Plan and Rezoning Application Update” be received.

BACKGROUND/DISCUSISON:

Official Community Plan Amendment Bylaw No. 848, 2012 and Land Use Amendment Bylaw No. 849, 2012 were given first and second reading. On December 4, 2012, a public hearing was held, followed by third reading of the bylaws. Fourth reading of Land Use Bylaw Amendment Bylaw No. 849, 2012 is conditional on the following:

  1. Approval from the Ministry of Transportation and Infrastructure
  2. Registration of a covenant to secure the following: a. Dedication of the 1.58 ha park as part of Phase 2 of the project; b. Construction of trails in or near the park as part of Phase 2 of the project; c. A statutory right-of-way for public and access to the proposed park as part of Phase 2 of the project; and d. Requirement that Building 2 to be constructed as a one storey building
  3. Provision of the $1 million community amenity contribution offered by the applicant be provided coincident with final reading of Land Use Bylaw Amendment Bylaw No. 849, 2012

Approval from the Ministry is expected shortly as of the date of this report. If the approval is not received by April 30, 2013, consideration of fourth reading of the bylaws would be postponed to a future Council meeting. The covenant is being registered on the property titles and arrangements have been made for the cash community amenity contribution to be held in trust pending fourth reading of the rezoning bylaw.

RECOMMENDATION:

That the report dated April 26, 2013 report from the Senior Planner titled “Official Community Plan and Rezoning Application Update” be received.
