8.1 STAFF REPORTS

Staff Recommendation:

THAT Environmental Development Permit No. 2013/06 be approved;

AND THAT Environmental Development Permit No. 2013/06 incorporate the following variances:

a. Variance to permit a 3.0m railing/retaining wall height (maximum 2.0m permitted); b. Variance to site a raised patio 1.0m from the side lot line (2.14m required); c. Variance to site a raised patio 9.6m from the natural boundary (15.0m required); d. Variance for the location of the existing waterfront deck and staircase 0m from the rear lot line (15.0m required);

AND FURTHER THAT Environmental Development Permit No. 2013/06 include a condition to require that a minimum of 0.6m be removed from the top of the existing retaining wall for the part that is 9.0m from the natural boundary.

Staff Report:

THAT Council approve Environmental Development Permit 2013/03 to permit the construction of side yard stairs and rear yard stairs.

AND THAT Development Permit 2013/03 include the following variances:

  • Variance to the 15m setback from the natural boundary of the sea as specified in Land Use Bylaw, 1990, No. 35 from 15m to 11.5 meters to permit the construction of an exterior stair structure;
  • Variance to the 2.14m setback from the side yard as specified in Land Use Bylaw, 1990, No. 35 from 2.14m to 1.5 meters to permit the construction of a front stairway and porch.
