RECOMMENDATION:
THAT Council give first, second and third readings to Municipal Ticket Information Bylaw No. 643, 2007, Amendment Bylaw No. 873, 2013.

I concur with the recommendation.
PURPOSE OF REPORT:
To amend Schedules 2 and 6 of the Municipal Ticket Information bylaw (MTI).
BACKGROUND:
Schedule 2 of the MTI Bylaw (see Attachment "A") is proposed to be amended to allow for ticket issuance when there are offences relating to secondary suites. Schedule 6 of the MTI Bylaw is proposed to be amended to establish differing ticket amounts for first and then subsequent offences.
DISCUSSION:
Bylaw No. 599 was the Land Use Bylaw amendment that introduced secondary suites into the municipality's regulatory regime. Currently, Schedule 2 of the MTI Bylaw does not list all of the ticketable offences established by Bylaw No. 599; therefore, the proposed amendments to Schedule 2 are to allow for ticketing in regard to home occupation within a home with a suite; an oversized suite area; and allowable parking spaces. As well, the amendment proposes an increased fee for non-permitted uses within a zone.
With respect to the proposed amendment to Schedule 6 of the MTI Bylaw, Section 5 of the Truck Route Bylaw No. 456 states:
"Every person who, without lawful excuse, contravenes this bylaw by willfully doing any act which forbids, or omitting to do any act which it requires to be done, is guilty of an offence and is liable on summary conviction to a fine of not less than $100.00 and not more than $300.00 for a first offence and for each subsequent offence to a fine or not less than $200.00 and not more than $500.00"
However, currently Schedule 6 of the MTI bylaw only allows for ticketable offences of $100 regardless of it being a first or subsequent offence for driving on unauthorized routes. This proposed amendment to the MTI Bylaw will allow for consistency between the Truck Route and the MTI Bylaws.
RECOMMENDATION:
THAT Council give first, second and third readings to Municipal Ticket Information Bylaw No. 643, 2007, Amendment Bylaw No. 841, 2013.
