a) Development Variance Permit Application No. 2013/02 – 333A Stewart Avenue
Report dated May 30, 2013 from the Senior Planner The Senior Planner gave a brief summary of the application to Council.
Comments from the Applicant B. Wilkin, designer and general contractor, stated that the property owners of both 333A and 335 Stewart Avenue wished to have gates on their properties that were matching for safety reasons and to avoid trespassing onto their property. They are requesting a variance to the gate from 1.0m to 1.55m in keeping with the scale of the homes. The height is measured to the top of the gate posts. The gates themselves would be approximately 1.2-1.3 m tall. The gates would have open rails that would be visually permeable.
G. Mathies, 333A Stewart Avenue, noted that he has spoken to ten neighbouring property owners; and with the exception of one neighbor all were in favour of the variance. He stated that there are several neighbouring properties which have fences higher than 1.0m including his neighbour to the east.
Council discussed the height; esthetics; setting of precedence; and potential safety concerns.

Comments from the Applicant B. Richards, 335 Stewart Avenue, stated his wishes to construct a fence 1.55m in height in order to deter people and animals from entering his property. He noted the proposed fence will be transparent; and that neighbouring properties have fences that are higher than the allowable height.
