1. CALL TO ORDER – Mayor Hill called the meeting to order at 7:00 p.m.

3. MINUTES, RECEIPT & ADOPTION OF a) Minutes of the Public Hearing held September 16, 2014 MOVED BY: Councillor Screech SECONDED: Councillor Rogers THAT the minutes of the Public Hearing held September 16, 2014 be adopted as presented. CARRIED

b) Minutes of the Council meeting held September 16, 2014 MOVED BY: Councillor Screech SECONDED: Councillor Rogers THAT the minutes of the Council meeting held September 16, 2014 be adopted as presented. CARRIED

4. MAYOR'S REPORT Mayor Hill spoke to Council regarding the Victoria Foundation's Vital Signs meeting held on October 7, 2014 which he attended with Councillor Screech.

5. PETITIONS & DELEGATIONS a) K. Logue, 333 Glenairlie Drive, Re: Fencing and the E&N Rail Trail Mr. Logue requested that Council consider an amendment to the Zoning Bylaw with regard to fence height for the back lot line of properties that border the E&N Rail Trail. The current bylaw limits fence height to 2.0 metres except for properties abutting an agricultural or commercial zone, in which case the maximum height is 2.5 metres.

The Director of Development Services proposed that the best solution for this specific issue in the Glenairlie neighbourhood would be a joint development variance application by the property owners on Glenairlie Drive.

J. Frederick, Capital Regional District Parks, noted that a full protection fence has been constructed where there is a retaining wall being constructed. If requested, and should municipal bylaws allow, fence heights can be constructed between 6-8 feet.

K. Miller, 319 Glenairlie Drive, indicated that he is looking for a sound barrier, privacy and security. He feels however that the current condition of his property would not support a fence.

The Director of Engineering stated that the CRD is willing to replace trees that have been removed and will be discussing this with residents of Glenairlie Drive which will help to create a barrier.

MOVED BY: Councillor Rast SECONDED: Councillor Screech C-120-14 THAT the property owners on Glenairlie Drive that back onto the new E&N Rail Trail be advised to submit a joint Development Variance Permit application seeking an amendment to the fence height along the rear lot line from 2.0m to 2.5m; AND THAT the Town absorb the fee for this Development Variance Permit application. CARRIED

8. REPORTS 8.1 STAFF REPORTS a) Rezoning for 408, 421, 429, 437, 441 and 445 Nursery Hill Drive – Report Presenting Town-initiated Rezoning Options

9. Report dated October 1, 2014 from the Planner The Director of Development Services gave a summary of the report to Council.

MOVED BY: Councillor SECONDED: Councillor C-121-14 THAT the Town initiate rezoning of the four properties (408, 421, 441 and 445 Nursery Hill Drive) where positive responses have been provided to the Town from CD-9C (Lakeside Village Low Density Residential) to CD-9CS (Lakeside Village Low Density Suite Residential) to include Secondary Suites as a permitted use on the lots; AND THAT the remaining two property owners (429 and 437 Nursery Hill Drive) be advised that the Town is proceeding with the Town initiated rezoning. CARRIED

b) Chilco Trails Request for Proposal

1. Report dated October 3, 2014 from the Director of Development Services MOVED BY: Councillor Screech SECONDED: Councillor Rast C-122-14 THAT Western Watershed Designs Inc. be awarded the contract to construct Chilco Trails Zones 1 and 2 for a total cost of $76,650 including GST; AND THAT the contract include construction of the observation platform at the cost of $8,800; finish landscaping at a cost of $3,000 and 2 dog bag stations at a cost of $1,400 and 2 map/sign for a cost of $1,400 for a total cost not to exceed $15,330 including GST; AND FURTHER THAT the supply of stones and granular for Zones 3 and 4 not be completed at this time. CARRIED

c) Statement of Understanding – Community Gardens

1. Report dated October 2, 2014 from the Engineering Clerk The Director of Engineering gave a summary of the report to Council. Council and staff discussed the ability to control rules and regulations in regard to the gardens; location of garden plots; maintenance of the garden beds; and overall standards and esthetics of the garden. J. Skrlac, 288 Eltham Road, requested that the Town consider grandfathering the three non-resident gardeners into the View Royal community gardens; and noted that the gardeners’ own funds will be used to establish the garden beds. MOVED BY: Councillor Screech SECONDED: Councillor Rogers C-123-14 THAT the Community Gardens Policy No. 5200-015 be amended to facilitate the incorporation of the former Craigflower Community Gardens group into the View Royal Community Gardens program. CARRIED

d) Shoreline Trail Funding Options

1. Report dated October 1, 2014 from the Director of Engineering MOVED BY: Councillor Screech SECONDED: Councillor Rogers C-124-14 THAT $10,000 from the 2014 sign kiosk funding be reallocated to facilitate the construction costs of the proposed Shoreline Trail. CARRIED

MOVED BY: Councillor Screech SECONDED: Councillor Rogers C-125-14 THAT ongoing funding be allocated for annual maintenance of the Shoreline Trail. CARRIED

e) Award of Tender for 2014 Asphalt Paving Works

1. Report dated September 20, 2014 from the Deputy Director of Engineering MOVED BY: Councillor Screech SECONDED: Councillor Rogers C-126-14 THAT the award of the 2014 Asphalt Paving Works Tender be awarded to Capital City Paving Ltd., in the amount of $152,296.00 (excluding applicable taxes); AND THAT Council approves the paving work on Island Highway fronting the new Public Safety Building to possibly be carried out between 7:00 p.m. and 5:00 a.m. (Monday to Friday) as detailed in the report from the Deputy Director of Engineering dated September 20, 2014. CARRIED

CARRIED

MOVED BY: Councillor Rast SECONDED: Councillor Mattson C-127-14 THAT funding for the Belmont skate park of up to $10,000 be considered in the 2015 budget process. CARRIED

b) Minutes of the Greater Victoria Public Library Board meeting held June 24, 2014 MOVED BY: Councillor Rogers SECONDED: Councillor Mattson THAT the minutes of the Greater Victoria Public Library Board meeting held June 24, 2014 be received. CARRIED
