Acting Mayor Mattson called the Public Hearing to order at 7:00 pm

2. APPROVAL OF AGENDA

3. PUBLIC HEARING

a) Statement of Public Hearing Procedure Acting Mayor Mattson made a brief statement regarding the procedures for public hearings.

b) Statement of Publication of Public Hearing The Senior Planner advised that the notice which advertised this Public Hearing was posted on the Notice Board at the Municipal Office on August 20, 2014. The Notice was also advertised in two consecutive issues of a newspaper being the Goldstream Gazette on Wednesday, August 27, 2014, and Friday, August 29, 2014. A total of approximately 488 notices were mailed on August 20, 2014 to owners and residents of land located within a 400 metre radius of the subject property.

4.1 STAFF REPORTS

a) Official Community Plan Amendment Application No. 2014/03 and Rezoning Application No. 2014/05 – 2427 Chilco Road (Thetis Vale Phase 7)

5. BYLAW FOR CONSIDERATION

a) Official Community Plan No. 811, 2011, Amendment Bylaw No. 896, 2014 A Bylaw to Amend the Official Community Plan with Respect to the Designation of 2427 Chilco Road

1. Comments from Municipal Staff The Senior Planner gave a summary of the July 25, 2014 report as presented to Council at the July 29, 2014 Council meeting.

2. Comments from the Applicant M. Johnson and M. Baier, Limona Construction, spoke to Council in regard to:

  • Phase 7 of development, specifically an additional $50,000 contribution for trail development; connection to Cheam Road; watercourse protection; and 40% of Phase 7 being dedicated as parkland;
  • increase in traffic and highway noise; and
  • infrastructure that has been installed by Limona Construction.

Council and the applicant discussed:

  • that the owner of the existing home is willing to have a covenant placed on the property to prohibit future subdivision;
  • possibility for first right of refusal to the Town or the Capital Regional District for purchase of the property from Mr. Woodworth;
  • protection of watercourse in Phase 7;
  • trail development contribution;
  • traffic issues; and
  • renaming of Cheam Road and house renumbering.

3. Comments from the Public a) M. Hargraves, 8 Cahilty Lane, spoke in regard to increased density and traffic.

b) M. Griffin, 19 Haagensen Court, questioned whether Phase 7 was part of the original plan.

c) J. Ouellet, 22 Haagensen Court, spoke against the rezoning and presented a petition to Council with 27 signatures against the development. He noted his concerns in regard to noise, traffic density, and the secondary access route.

d) M. Asplin, 301 Anya Court, noted his concerns regarding carbon neutrality and requested that Council focus on alternative forms of transportation.

e) L. Peterson, 26-2319 Chilco Road, spoke in favour of the development, noting the green space is private property currently but that the development will make it publically accessible green space and that the development will provide additional tax revenue to the Town.

f) B. Hill, 2383 Chilco Road, noted he is not concerned about the increase in traffic and is happy to have an alternative emergency access route.

g) K. Morency, 50 Haagensen Court, stated that when they purchased their home they were told that their area was protected and that there would not be any further development.

h) V. Kostova, 2356 Chilco Road, questioned what is being done in terms of biodiversity in the area and requested the area be protected in the future.

i) G. Bryant, 2422 Chilco Road, noted his concerns in regard to the connection to Cheam Road; drainage and riparian areas; and street names and numbering.

j) D. Leech, 2344 Chilco Road, noted he is in favour of the development and is happy with the 40% dedicated parkland. He noted that house numbering in the area is confusing.

k) D. Emrich, 16 Newcastle Court, stated he was in favour of the development and noted that the development is consistent with the Official Community Plan.
