1. CALL TO ORDER
Mayor Screech called the Public Hearing to order at 7:02 p.m.
The Mayor acknowledged that the meeting is being held on the traditional territory of the Songhees Nation and Esquimalt Nation.

3. PUBLIC HEARING
a) Statement of Public Hearing Procedure Mayor Screech made a brief statement regarding the procedures for public hearings.
b) Statement of Publication of Public Hearing The Community Planner advised that the notice that advertised this Public Hearing was posted on the notice board at Town Hall on August 19, 2022. The notice was also advertised in two consecutive issues of a newspaper being the Times Colonist on Wednesday, August 31, 2022 and Thursday, September 1, 2022. A total of approximately 529 notices were mailed on August 24, 2022 to owners and residents of land located within a 400 metre radius of the subject property.

4.1 STAFF REPORTS
a) Zoning Bylaw No. 900, 2014, Amendment Bylaw No. 1104, 2022 to Amend the R-1B Zone with Regard to 110 High Street
- Report dated August 26, 2022 from the Community Planner
The Community Planner gave a summary of the report to Council noting that the proposal is to rezone the existing R-1 (detached residential – large lot) zone to an R-2 (duplex residential) zone.
Council and staff discussed zoning, siting of proposed buildings on the property, parking, road improvements, screening and privacy and tree removal/retention.

THAT, should Council proceed with readings, a covenant be registered concurrent with fourth reading of Zoning Bylaw No. 900, 2014, Amendment Bylaw No. 1104, 2022 to secure the provision of a community amenity contribution of $4,000 per residential unit prior to building permit issuance. CARRIED

Comments from the Applicant N. Banks, designer, noted the proposal is for a low-density development. He discussed tree retention, reasoning for a duplex as opposed to a subdivision, road improvements, parking, landscaping and fencing.
Council and the designer discussed landscaping.
- Comments from the Public a) M. Johnston-Stewart, 100 High Street, questioned the location of the garage as this would directly impact her property.
b) D. Stewart, 88 High Street, noted there is a concern with people parking on High Street and feels lighting is required. He questioned the spot zoning approach for this property.
