BYLAW NO. 1090
A BYLAW TO AUTHORIZE THE DISPOSITION OF PARK LAND TO THE CAPITAL REGIONAL DISTRICT
WHEREAS, pursuant to Section 29 of the Community Charter, land in a municipality that is dedicated to the public for the purpose of a park by a subdivision plan deposited in the land title office is vested in the municipality for that purpose;
AND WHEREAS, pursuant to Section 27(2)(b) of the Community Charter, a council, may, by bylaw adopted with the approval of the electors, dispose of a portion of such park land and place the proceeds of the disposal to the credit of a reserve fund under section 188(2)(b) [park land acquisition reserve fund] of the Community Charter.
AND WHEREAS it is deemed desirable to transfer park land as hereinafter described to the Capital Regional District for incorporation into the Capital Regional District’s regional park system;
NOW THEREFORE, the Council of the Town of View Royal in open meeting assembled, enacts as follows:
The Council is hereby authorized and empowered to dispose by sale to the Capital Regional District of the parcel of land with the legal description of Section 98, Esquimalt Plan EPP55963, Dedicated Park, shown as “Subject Area” on the sketch plan attached to this bylaw as Schedule “A”, in exchange for a sum of $34,450.
The proceeds of the disposal are to be placed to the credit of the Town’s park land acquisition reserve fund.
The Mayor and Chief Administrative Officer are authorized to execute all documents necessary to carry out the completion of the park disposal authorized by this bylaw.
This bylaw may be cited as “Disposition of Park Land Bylaw No. 1090, 2022”.

An alternative approval process in relation to this Bylaw was provided in accordance with the requirements of sections 27 and 86 of the Community Charter and the elector response was certified as not having exceeded 10% of the electors of the Town of View Royal on the ____ day of ______________, 2022.
